04. 28.09.2016 Heard learned counsel for the petitioner and learned counsel for the S
tate.
The petitioner is an accused in G.R. Case No.538 of 2016 on th
e file of learned J.M.F.C.(P), Kujanga registered under Sections 341/294/420/506/34, I.P.C.
It has been alleged that the petitioner took a loan of
Rs.1,60,000/- in two occasions from two SHG groups of his village but did not refund the amou
nt and abused and misbehaved the SHG group members when they demanded the money.
It is submitted by learned counsel for the petitioner that he
had not taken any loan from the SHG groups and has been falsely implicated in this case due to
some village dispute. It is further submitted that charge sheet has already been submitted in
this case. It is seen from the charge sheet that some resolution books of the SHG groups were
seized which show that the petitioner was granted with some loan. It is also submitted that t
he petitioner is in custody since 11.06.2016.
Considering the submissions and the materials placed b
efore the Court, it is directed that the petitioner be released on bail by furnishing cash sec
urity of Rs.20,000/- (rupees twenty thousand) besides a bond of Rs.30,000/- (rupees thirty tho
usand) with two sureties for the like amount to the satisfaction of the learned J.M.F.C.(P), K
ujanga in G.R. Case No.538 of 2016 with the condition that he shall not give out any threat to
wards the prosecution witnesses in any manner whatsoever.
The BLAPL is accordingly disposed of.
