21.07.2016 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is an accused in S.T. Case No.154 of 2015 on the file of learn
ed Additional Sessions Judge, Chatrapur, Ganjam registered under Sections 302/307/34, I.P.C.
Learned counsel for the petitioner submits that excepting injured father of the decea
sed, there was no other eye witnesses to the occurrence and there was certain discrepancies in
the F.I.R. story and the statement of the victim.
Learned counsel for the State placed before the Court the statement of the informant a
nd the father of the deceased showing specific allegation of assault by the present petitioner
resulting death of the victim.
Considering the specific allegation as leveled against the present petitioner,
I am not inclined to grant the benefit of the bail to the petitioner. Accordingly the bail ap
plication stands rejected.
Since it is submitted that the case has already been committed to the Court of Session
s, learned trial court would do well to dispose of the application in accordance with law as e
xpeditiously as possible.
The ABLAPL is accordingly disposed of.
