This is an application under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with G.R. Case No. 791 of 2016 arising out of Kumbharapada P.S. Case No. 124 of 2016 pending in the Court of learned S.D.J.M., Puri for alleged commission of offe nces under Sections 341/323/294/354/379/307/453/506/34 of the Indian Penal Code.

Perused the FIR. Learned counsel for the petitioner submits that due to previous dispute between the pa rties, the case has been foisted. Learned counsel for the petitioner further submits that the injured has not sustained any grievous injury and therefore, the anticipatory bail application of the petitioner may be favourably considered.

Learned counsel for the State opposed the prayer for bail and placed the injury report o f injured Anand Pradhan who has sustained simple injury. Considering the submissions of learned counsels for the respective parties, the nature of accusation against the petitioner and the previous dispute between the parties and the inj ury sustained by the injured, I am inclined to release the petitioner on anticipatory bail and accordingly, this Court directs that in the event of arrest of the petitioner in connection w ith the aforesaid case, he shall be released on bail on furnishing bail bond of Rs.5,000/- (r upees five

thousand) with two solvent sureties each for the like amount to the satisfaction of t he arresting officer with further conditions that he shall make himself available for i nterrogation by the I.O. as and when required and he shall not directly or indirectly m ake any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing any facts to the Courts or to the investigating Officer. Violation of any of the above conditions shall entail cancellation of bail. The ABLAPL is accordingly disposed of. Urgent certified copy of this order is granted on proper application.
