The petitioner moved an application for bail before the Court of learned Judge, Specia
l Court, Angul which was rejected on 19.04.2016.
Learned counsel for the petitioner submits that the petitioner is in custody since 07.
04.2016 and in the meantime, after completion of investigation, charge sheet has been submitte
d. He further submits that the petitioner is a poor labourer and falsely entangled in the case
and he was not arrested from the spot. He further submits that there is absolutely no clinchi
ng material against the petitioner and the bar under section 37 of the NDPS Act is not applica
ble for such offence and therefore, taking into account the period of detention of the petitio
ner in judicial custody, the bail application of the petitioner may be favourably considered.
Learned counsel for the State has produced the case diary and placed the statements of
Gramarakhi namely Rabi Naik and home guard.
Considering the submissions of learned counsels for
