Heard learned counsel for the petitioner and learned Addl. Government Advocate.
The petitioner is apprehending arrest for the alleged commission of offences under Sec
tions 467 and 471 of the I.P.C. in connection with State C.I.D. P.S. Case No.3 of 2015.
It is apparent from the records that the allegation against the present petitioner is
that he used a forged certificate issued by Kendriya Hindi Sansthan, Agra. It is further borne
out from the records that the petitioner has not himself forged the document as he has obtain
ed the same without knowing the same to be forged. It is also seen that the petitioner has not
availed the benefit of appointment by producing such allegedly forged document. Co-accused Dh
armaranjan Pati, who stands in the same footing, has been granted bail by order of the Court d
ated 12.11.2015 passed in ABLAPL No. 11588 of 2015. The petitioner is a permanent resident of
village-Kendabahal, P.S. Sohela, Dist. Bargarh and there is no chance of his absconding from j
ustice.
Keeping in view the aforesaid consideration and the facts of the case, the application
for anticipatory bail is allowed. It is directed that on the event of arrest, the petitioner
shall be released on bail on such terms and conditions as deemed just and proper by the Arrest
ing Officer. However, it is directed that he shall continue to cooperate with the investigatio
n of the case and shall remain himself present before the Investigating Officer as and when re
quired by him.
The ABLAPL is accordingly disposed of.
