2. 19.12.2016 The petitioners have been implicated in G.R.Case No.1025 of
2012 arising out of Tangi P.S. Case No.196 of 2012 registered for alleged commission of offen
ce under sections 147/148/294/506/323/427/149 IPC pending in the court of learned N.G.N.-Cum
-J.M.F.C., Tangi. So they have filed this application under Section 438 of the Cr.P.C.
Learned counsel for the petitioners submits that in this case investig
ation is already complete and other co-accused persons similarly situated with the petitioners
have already been released on bail when these petitioners name finding place in the charge sh
eet, the learned court below has issued NBWs against them for which they have approached this
Court apprehending arrest
Learned Addl. Standing Counsel opposes the move.
Considering the submission, viewing the nature of accusations and othe
r surrounding circumstances of the case, in the absence of any other impediment, it is directe
d that in the event the petitioners surrender before the court in seisin of the case within a
period of fifteen days hence and move for their release on bail, they be released on bail on s
uch terms and conditions as would be deemed just and proper by the said court with further con
dition that they will not terrorize or threaten the prosecution witnesses or indulge in any cr
iminal activity.
