 State.

2. The petitioner is apprehending arrest for the alleged commission of offence under Secti
on 409 of the I.P.C. in G.R. Case No.832/2013 of the court of learned J.M.F.C., Jajpur Road ar
ising out of Jajpur Road P.S. Case No.251/2013.

3. It is agreed at the bar that as far as accused Susanta Kumar Sahoo is concerned, during
his tenure there was withdrawal of Rs.10,000/- only from the account of the deceased father o
f the complainant. In the mean time co-accused namely, Amulya Kumar Mallick @ Amulya Malik h
as already been granted anticipatory bail in ABLAPL No.6615/2016 as per order 6.5.2016.

4. Keeping in view the nature of allegations made and the facts of the case, this Court is
 inclined to grant anticipatory bail to the petitioner. Accordingly, the anticipatory bail app
lication of the petitioner is allowed. On the event of his arrest, he shall be released on bai
l by the arresting officer on such terms and conditions as deemed just and proper by him in t
he aforesaid case. However, it is directed that the petitioner shall co-operate with the inve
stigation of the case and shall remain present before the I.O. as and when required and produ
ce all relevant documents so desired by the I.O.

 The ABLAPL is disposed of.

 Urgent certified copy of this order be granted on proper application.
