Heard learned counsel for the petitioners and learned Addl. Government Advocate for the
State.
Petitioners are apprehending arrest for the alleged commission of offence under Sections
147/148/341/384/379/324/323/120-B/149 of the I.P.C. in G.R. Case No.1342/2016 of the court of
learned S.D.J.M., Angul arising out of Angul P.S. Case No.500/2016.
The Police has recently registered the offence under Section 383 of the I.P.C. instead of
384 of the I.P.C. Offences under Sections 384 and 379 of the I.P.C. alleged to have been comm
itted by the petitioners are punishable with term of imprisonment not exceeding seven years.
It is further noted that the petitioners is a permanent resident of village - Similipada, P.S
.- Angul in the district of Angul. Hence there is no chance of their absconding from justice.
There is no allegation on behalf of the State that the petitioners will tamper the prosecution
evidence, if he is released on bail.
Keeping in view the aforesaid consideration, nature of the allegations made and the facts
of the case, application for anticipatory bail is allowed. In the event of arrest of the peti
tioners in the aforesaid case, they shall be released on bail by the arresting officer on such
terms and conditions as deemed just and proper by him.
The ABLAPL is disposed of.
