21.11.20161. Heard learned counsel for the petitioners and learned Addl. Government Advocate for the Sta
te.

2. The petitioners are apprehending arrest for the alleged commission of offences under Sectio
ns 143/341/294/387/149 of the I.P.C. in G.R. Case No.530/2016 of the court of learned J.M.F.
C., Barbil, arising out of Joda P.S. Case No.150/2016.
3. Keeping in view the nature of the allegations made, the facts of the case and the criminal
antecedents against the present petitioners as conceded by the learned counsel for the petitio
ners, this Court is not inclined to grant anticipatory bail to them.

4. However, the petitioners are given liberty to surrender in the aforesaid case before the le
arned J.M.F.C., Barbil in the first hour, within a period of twenty one days hence, and file a
n application for bail. On such event, the learned J.M.F.C., Barbil shall consider their appli
cation for bail in the first hour. In case of rejection of the bail application, petitioners m
ay move for bail before the higher forum in the second hour. On such event, the higher forum s
hall consider and dispose of the bail application of petitioners on the same day.
5. Records be transmitted to the higher forum at the cost of petitioners, if applied for.
6. It is made clear that this Court has not expressed any opinion on the merits of any future
application that may be filed before the higher forum by the petitioners under Section 439 of
the Cr.P.C.

7. The ABLAPL is disposed of.
