This is an application to modify the order dated 18.11.2016 in ABLAPL No.16876 of 2016
wherein the petitioner has given liberty to surrender before the learned J.M.F.C.(R), Cuttack
in first hour within twenty-one working days hence and file an application for bail. On such
event, the learned Magistrate shall consider his application for bail in the first hour. In ca
se of rejection of the bail application, the petitioner may move for bail before the higher fo
rum in the second hour. On such event, the higher forum shall consider and dispose of the bail
application of the petitioner on the same day.
However, it is submitted by the learned counsel for the petitioner that, in the meanti
me, the co-accused has been released on bail by this Court in BLAPL No.4666 of 2016 and BLAPL
No.4905 of 2016.
Accordingly, the order is modified to the extent that while disposing of the bail appl
ication of the petitioner, the higher forum shall keep in mind the principles of parity, if ap
plicable. This order shall be read as a part of the order dated 18.11.2016.
The Misc. Case is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
