The petitioners are apprehending arrest for the alleged commission of offences under S
ections 448, 353, 355, 294, 379 and 506 of the I.P.C. read with Section 135 of the Indian Expl
osives Act in G.R. Case No. 895 of 2016 of the court of J.M.F.C., Chandikhole, arising out of
Kuakhia P.S. Case No. 150 of 2016.
Learned counsel for the petitioners submits that no criminal antecedents are reported
against the petitioners.
Keeping in view the aforesaid consideration, facts of the case and the fact that the p
etitioners are permanent residents of Village- Bhotaka, P.S. Kuakhia, Dist. Jajpur and there i
s no reasonable apprehension of their fleeing from justice, the application for anticipatory b
ail is allowed. Moreover, there is no allegation that the petitioners shall tamper with the pr
osecution evidence, if they are released on bail. It is directed that on the event of arrest,
the petitioners shall be released on bail on such terms and conditions as deemed just and prop
er by the Arresting Officer.
