03.03.2016 Heard learned counsel for the petitioner and learned Addl. Government
Advocate.
The petitioner is apprehending arrest for the alleged commission of offence un
der Sections 452, 363, 377, 294, 323, 506, 354, 144/34 of the IPC read with Sections 4 and 17
of the POCSO Act in Special Case No.63/2015 of the court of learned Special Judge, Angul, ari
sing out of Athamallik P.S. Case No.59/2015.
Counsel for the petitioner wants to withdraw the bail application with a liber
ty to surrender before the lower court and apply for bail so that his bail application shall b
e considered and disposed of by the court having jurisdiction to do so.
Hence, the ABLAPL is disposed of as withdrawn.
The petitioner is given liberty to surrender in the aforesaid case before the
learned Special Judge, Angul within 21 working days hence and move for bail. On such event, th
e learned Special Judge shall consider his application and dispose of the same on the same day
on merit. This Court has not expressed any opinion on the merits of the case of the petitione
r as far as any future application under Section 439 Cr.P.C. that may be filed before the Sess
ions Judge, Angul.
