01.3.2016. Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the V
igilance Department.

2. The petitioners are apprehending arrest for the alleged commission of offence under Sec
tion 109 of the I.P.C. and Section 13(2) read with 13(1) (e) of the P.C. Act in Vigilance G.R.
 Case No.43/2015 of the court of learned Special Judge (Vigilance), Berhampur arising out of B
erhampur Vigilance P.S. Case No.63/2015.

3. Keeping in view the quantum of disproportionate assets, the fact that petitioner no.1 i
s a public servant and petitioner no.2 happens to be his wife and they are permanent resident
s of village Kukudakhandi, Sana Sahi, in the district of Gajapati and there is no chance of
their absconding from justice, this Court is inclined to grant anticipatory bail to them. Acco
rdingly, the anticipatory bail application of the petitioners is allowed. On the event of thei
r arrest, they shall be released on bail by the arresting officer on such terms and conditions
 as deemed just and proper by him in the aforesaid case. It is further directed that they shal
l co-operate with the investigation, shall also produce documents as required by the Investiga
ting Officer and shall remain present before the Investigating Officer as and when required by
 him.

 The ABLAPL is disposed of.

 Urgent certified copy of this order be granted on proper application.
