06.01.2016 Heard learned counsel for the petitioner and learned Additional Standi
ng Counsel for the Vigilance Department.
The petitioner is apprehending arrest for the alleged commission of offence un
der Section 7 of P.C. Act in V.G.R. Case No.41 of 2015 of the court of learned Special Judge (
Vigilance), Cuttack, arising out of Cuttack Vigilance P.S. Case No.39 of 2015.
In course of hearing, the learned counsel for the petitioner wants to withdraw
the application, so that he may surrender before the learned Special Judge (Vigilance), Cutta
ck in the aforesaid case within 21 working days hence and pray for bail. On such event, his ap
plication shall be considered and disposed of on merits by reasoned order. Case Diary be made
available to the concerned courts. It is made clear that this Court has not expressed any opin
ion on the merits of the case, so far as any future application under Section 439 of Cr.P.C is
concerned. Interim order passed earlier stand vacated.
The ABLAPL is disposed of accordingly.
Urgent certified copy of this order be granted as per rules. .
