 Heard learned counsel for the petitioner and learned Addl. Government

 The petitioner is apprehending arrest for the alleged commission of offence un
der Sections 341, 294, 323, 353/34 of the IPC read with Section 3(1)(x) of the SC and ST (PA)
Act in G.R. Case No.66/2016 of the court of learned SDJM, Jagatsingpur, arising out of Jagatsi
nghpur P.S. Case No.12/2016.
 No offence under Section 3(1)(x) of the SC and ST (PA) Act is made out from th
e facts of the case and as per the ratio decided by this Court in Ratikant Ray v. State of Odi
sha, (2015) 61 OCR 217. Hence, Section 18 of the Special Act is not applicable to the present
case. None of the other offences allegedly committed by the petitioner are punishable with imp
risonment for terms exceeding 7 years. The petitioner is a permanent resident of Purana, P.S./
Dist.Jagatsinghpur. So, there is no chance of his absconding from justice.

 Keeping in view the aforesaid consideration and the facts of the case, applica
tion for anticipatory bail is allowed. In the event of his arrest in the aforesaid case, the p
etitioner shall be released on bail by the arresting officer on such terms and conditions as d
eemed just and proper by him.
. The ABLAPL is disposed of accordingly.
 Urgent certified copy of this order be granted as per rules.
