Considering the contention raised by learned counsel for the parties without expressin
g any opinion on the merits of the case, it appears that the petitioner had earlier approached
this Court by filing W.P.(C) No. 14065 of 2014 which was disposed of on 06.08.2014 directing
the opposite party no.3- D.E.O., Balasore to consider his representation. On considering the r
epresentation filed by the petitioner, the D.E.O., Balasore has rejected his claim for grantin
g GIA salary for the period he was placed under suspension and the said order has not been cha
llenged before any forum. In any case, vide order dated 16.11.2015 under Annexure-15, Sri Joge
ndra Kumar Rout has been allowed to continue as Headmaster-in-Charge by virtue of the interim
order dated 26.11.2013 passed in Appeal Case No. 28 of 2013. Instead of contesting in the appe
al case which is pending before the State Education Tribunal, the petitioner has approached th
is Court. Therefore, this Court is not inclined to entertain this application. However, libert
y is granted to the petitioner to approach the appropriate forum ventilating his grievance if
so advice.
