04. 19.11.2015 Heard learned counsel for the petitioner and learned c
ounsel for the intervenor.
Learned counsel for the petitioner seeks to withdraw the present writ
application, inter alia, on the ground that the excise year 2012-13 has already been expired a
nd hence, no cause of action subsists.
Mr.Jena, learned counsel for the intervenor submits that in view of th
e interim direction of this Court, though the intervenor had been a successful bidder and depo
sited necessary consideration money, since he was not allowed to operate, he submits that he h
as no interest in operating the said shop and prays for direction to the State to refund the a
mounts deposited by the intervenor.
Accordingly, the writ petition stands dismissed as withdrawn with furt
her direction to the State to refund the amount, if any, deposited by the intervenor before Op
posite Party No.2-Collector within a period of four weeks from today.
Free copy of this order be handed over to the learned counsel for the
State. Urgent certified copy of this order be granted on proper application.
