On perusal of records, it appears that the parents of the petitioner are Late Gangadha
r Mohanty (father) and Late Nirjharini Mohanty @ Devi (mother). During their life time the pa
rents of the petitioner had made a Special Term Deposit under Reinvestment plan at State Bank
of India, Cuttack City Branch, College Square, Cuttack on 26.10.1992/27.10.1997 for 39 months
with the deposit of Rs.41,515/- at the rate of 12% interest per annum. The term deposit was d
ue on 26.01.2001 with the maturity amount of Rs.60,966/-. Accordingly, the Bank had issued th
e Special Term Deposit receipt No.SD/A30-622628 in the names of the petitioners parents jointl
y. Prior to maturity of the aforementioned Special Term Deposit the mother of the petitioner
namely Nirjharini Devi @ Mohanty died on 01.10.1999 and father of the petitioner died on 24.01
.2000 leaving behind the petitioner and opposite party Nos.2 and 3 to succeed their property.
The Tahasildar, Sadar, Cuttack has also issued Legal Heir Certificate of the deceased parent
s of the petitioner vide Misc. Certificate No.1321 of 2012. The petitioner and opposite parti
es are entitled to receive 1/3rd shares each from the maturity amount of the Special Term Depo
sit under Annexure-1 along with its accrued interest till the date of actual payment in thre
e equal shares. After
