 02. 02.11.2015 Heard learned counsel for the peti
tioner and learned Addl. Standing Counsel for the State.
 The petitioner defaulted in appearance on 22.06.2015. N.B.W.-A was issued agai
nst him. He was arrested on 23.07.2015 and produced in custody.
 It is submitted by learned counsel for the petitioner that, as the petitioner
was not conveyed about the date of posting of the case by the Lawyer, he had engaged, he could
 not appear on the date fixed. It is further submitted by learned counsel for the petitioner t
hat, the petitioner shall abide by the conditions and cooperate till completion of the trial.
 Taking into consideration the facts and submissions and factum of permanent re
sidence of the petitioner, it is directed that the petitioner shall be released on bail by the
 learned Addl. District & Sessions Judge, Jajpur in C.T. Case No.198 of 2009 on such terms and
 conditions as deemed just and proper in the facts and circumstances of the case.

 The bail application is accordingly disposed of.
 Urgent certified copy of this order be granted as per rules.
