Mr. Amit Prasad Bose and associates enter appearance today in Court by filing Vakalatn
ama with the consent of the previous Advocate. The Vakalatnama be kept on record.
Heard learned counsel for the petitioners and learned Additional Stand
ing Counsel for the State.
The petitioners are implicated in the offence punishable under Section
395, IPC. So far as petitioner no.2-Trilochan sindria is concerned, his basis of implication
is his confessional statement before the police and recovery of a stolen mobile phone at his i
nstance. So far as petitioner no.1-Parsuram Patel is concerned, his basis of implication is hi
s confessional statement before the police only.
Charge-sheet in the case is stated to have been filed in the meantime.
Learned counsel for the petitioners submits that there is no record of past cr
iminal antecedent against the petitioners.
Considered the materials placed by learned counsels for the parties.
Taking into consideration the facts and submissions, factum of permanent resid
ence of the petitioner and completion of investigation, it is directed that each of the petiti
oners shall be released on bail by the learned S.D.J.M., Biramaharajpur in G.R. Case No. 01 o
f 2012 on such terms and conditions as deemed just and proper.
The Bail Application is accordingly disposed of.
Urgent certified copy of this order be granted as per rules.
