The petitioner is implicated in the offence punishable under Sections
302, 34 IPC and other allied offences.
One Litan Samal is alleged to have assaulted to the deceased on his head with
a wooden plank. So far as the present petitioner and others are concerned, they are alleged t
o have assaulted the injured eye-witness-namely Grirish Chandra Mohapatra. Co-accused similarl
y circumstanced with the present petitioner has already been released on bail as submitted at
the Bar.
Charge-sheet is stated to have filed in the meantime.
Considered the materials placed by the learned counsel for the parties.
Regard being had to the facts and submissions, nature of allegation as against
the present petitioner, the factum of his permanent residence and completion of investigation
, it is directed that the petitioner shall be released on bail by learned S.D.J.M., Banki, in
G.R. Case No.216 of 2015 on such terms and conditions as deemed just and proper.
The bail application is accordingly disposed of.
