 04. 04.12.2015 Heard learned counsel for the petitioner and l
earned Additional Standing Counsel for the State.

 The petitioner is implicated in the offence punishable under Sections
20 (b) (ii) (C) of the N.D.P.S. Act.
 Nothing was seized from the possession of the present petitioner. He was appr
ehended after about four months on the basis of the statement of the co-accused, from whom 146
 Kgs. (one quintal forty six kilograms) of contraband Ganja was seized. Except the confessiona
l statement of co-accused, there is no material on record to implicate the present petitioner,
 as submitted by the learned counsel for the petitioner.
 Prosecution Report in the case is stated to have been filed in the meantime.
 It is submitted at the Bar that there is no record of past criminal antecedent
 against the present petitioner.
 Considered the materials placed by learned counsels for the parties.

 Taking into consideration the facts and submissions, factum of permane
nt residence of the petitioner, nature of evidence and completion of inquiry in the meantime,
it is directed that the petitioner shall be released on bail by the learned Special Judge, Ang
ul in Special Case No.77 of 2013 on such terms and conditions as deemed just and proper.

 The Bail Application is accordingly disposed of.
 Urgent certified copy of this order be granted as per rules.
