03.09.2015 Heard learned counsel for the petitioner and learned Additional Standing C
ounsel for the State.
 The petitioner is apprehending arrest for the alleged commission of offence un
der Sections 147, 148, 294, 323, 324, 326, 307, 379 and 506/149 of the IPC in C.T. Case No.481
 of 2015 of the court of learned S.D.J.M., Deogarh, arising out of Deogarh P.S. Case No.184 of
 2015.

 In course of hearing, the learned counsel for the petitioner wants to withdraw
 the anticipatory bail application with a liberty to surrender before the lower court and appl
y for bail so that his bail application shall be considered and disposed of by the court havin
g competent to do so.

 In that view of the matter, the anticipatory bail application is disposed of g
ranting liberty to the petitioner to surrender in the aforesaid case before the learned S.D.J.
M., Deogarh in the first hour within 21 days hence and move for bail. On such event, the learn
ed Magistrate shall consider his application for bail in the first hour strictly on the basis
of the materials on record. In case of rejection of the bail application, the petitioner may m
ove for bail before the higher forum on the second hour. On such event, the higher forum shall
 consider and dispose of the bail application of the petitioner on the same day strictly on th
e basis of the materials on record. Case Diary be made available to the concerned courts. Reco
rds be transmitted to the higher forum at the cost of the petitioner, if applied for. The Cour
t below shall keep in mind the principles of parity while disposing of the bail application of
 the petitioner.
