03.09.2015 Heard learned counsel for the petitioner and learned Addl. Government Advocate.
The petitioner is apprehending arrest for the alleged commission of offences under Sec
tions 452, 294, 325, 307, 354, 333, 380 and 427/34 of the I.P.C. read with Section 7 of the Cr
iminal Law Amendment Act and Section 3 of the P.D.P.P. Act in G.R. Case No.447 of 2014 of the
court of S.D.J.M., Kendrapara, arising out of Kendrapara Town P.S. Case No.46 of 2014.
Learned counsel for the petitioner submits that co-accused persons, who stands in the
same footing as the present petitioner, have been released on bail by order dated 02.05.2014 o
f this Court in BLAPL No.7354 of 2014.
Keeping in view the nature of allegations and the facts of the case, this Court is inc
lined to grant anticipatory bail to the petitioner. Learned counsel for the petitioner submits
that in the meantime charge-sheet has been filed against the petitioner.
It is directed that the petitioner is given liberty to surrender before the learned S.
D.J.M., Kendrapara within 21 days in connection with the aforesaid case and apply for bail. In
such event, the learned Magistrate shall release him on bail on such terms and conditions as
deemed just and proper by him.
It is further directed that on the event the petitioner is arrested in the meantime, t
he Arresting Officer shall produce him before the learned S.D.J.M., Kendrapara within 24 hours
and the learned Magistrate shall grant him bail as directed above.
The ABLAPL is accordingly disposed of.
