The petitioner is apprehending arrest for the alleged commission of offence un
der Sections 461, 466, 467, 471 and 120-B of the IPC in G.R. Case No.831 of 2015 of the court
of learned S.D.J.M., Angul, arising out of Angul P.S. Case No.299 (23) of 2015.
Perused the records, especially statement of the different accused persons rec
orded by the Sub-Collector, Angul in fact the petitioners have submitted their statements in t
heir hand writing before the Sub-Collector, Angul, who also have the powers of a Magistrate. T
he main accused, namely, Manasis Mishra has categorically stated that he was involved in manip
ulation and forgery. The petitioner belongs to Scheduled Caste Category. It is submitted by th
e learned counsel for the petitioner that the present petitioner is no way involved in the abo
ve activity. The said petitioner has also giving in writing that he has no idea of forgery of
two permission order granted by the Sub-Collector, Angul.
Keeping in view the aforesaid facts, this Court is of the opinion that the pet
itioner-Susanta Datta Behera is a member of scheduled caste category and permanent resident of
Amlapada 6th lane, PS-Angul, Dist. Angul, there is no chance of his fleeing from justice. Sin
ce the matter has been carefully documented by the Sub-Collector, Angul, there is no chance of
his tampering with the prosecution evidence.
Keeping in view the aforesaid consideration and the facts of the case, applica
tion for anticipatory bail is allowed. In the event of his arrest in the aforesaid case, the p
etitioner shall be released on bail by the arresting officer on such terms and conditions as d
eemed just and proper by him.
The ABLAPL is disposed of accordingly.
Urgent certified copy of this order be granted as per rules.
