09.9.2015. Heard learned counsel for the petitioner and learned Addl. Government Advocate for the
State.
2. This is a successive bail application filed by the petitioner. Petitioner is apprehending
arrest for the alleged commission of offence under Sections 498-A/326/307/302 of the I.P.C. a
nd Section 4 of the D.P. Act in G.R. Case No.22/2013 of the court of learned J.M.F.C., Rampur
arising out of Rampur P.S. Case No.5/2013.
3. Careful examination of the case diary especially the dying declaration of the deceased r
ecorded by the Executive Magistrate-Cum-Addl. Tahasildar, Subarnapur reveals a clear case of o
ffences under Sections 302 and 304-B of the I.P.C. against the present petitioner. The petit
ioners earlier applications for anticipatory bail were disposed of as not pressed.
4. Keeping in view the nature of the allegations made, the gravity of the offences, greate
r and larger interest of the State and society, this Court is not inclined to grant anticipato
ry bail to the present petitioner.
Accordingly, the ABLAPL is rejected.
