22.9.2015. Heard learned counsel for the petitioners and learned Addl. Government Advocate for t
he State.
2. Petitioners are apprehending arrest for the alleged commission of offence under Sections
454/380/34 of the I.P.C. in G.R. Case No.102/2015 of the court of learned N.G.N., Sanakhamundi
arising out of Pattapur P.S. Case No.103/2015.
3. Learned Addl. Government Advocate reports that there are no criminal antecedents against
the present petitioners. It is further seen from the record that the petitioners have though
named in the F.I.R., the informant has no prior acquaintance with them and the accused, who wa
s caught at the spot, has stated the name of the present petitioners. The statement made by th
e accused- Sagar Sahu, who was caught at the spot, before the informant cannot be taken into c
onsideration as extra judicial confession.
4. Keeping in view the aforesaid consideration, nature of the allegations made and the fact
that there is no other materials against the present petitioners, application for anticipator
y bail is allowed. In the event of arrest of the petitioners in the aforesaid case, they shall
be released on bail by the arresting officer on such terms and conditions as deemed just and
proper by him.
The ABLAPL is disposed of.
