Applicant-Syed Ali Abbas filed O.A. No. 121/2024 alleging causing of air and water pollution and discharge of toxic gases and pollutants by Project Proponents impleaded as respondents no. 5 to 11.

Applicant-Sanavvar sent letter petition to this Tribunal, which has been treated and registered as O.A. No. 269/2024, alleging causing of air and water pollution and discharge of toxic gases and pollutants by the Project Proponents mentioned therein and the Project Proponents are impleaded as respondents no. 5 to 21.

In both the cases this Tribunal constituted Joint Committee with

directions to verify the factual position and submit report.

Reports of the Joint Committee were filed vide emails dated 22.04.2024 and 08.11.2024 in O.A. No. 121/2024 and vide email dated

03.08.2024 in O.A. No. 269/2024 respectively.

Reports/replies have been filed by the respondents in the course of proceedings which are on record of the cases.

Mr. Rahul Khurana, Advocate was appointed as Amicus Curiae vide order dated 05.08.2024 in O.A. No. 269/2024. 7. Report dated 16.12.2024 has been filed by Mr. Rahul Khurana Amicus Curiae.

In the course of hearing, it was pointed out that Project ProponentSaras Paper Product Pvt. Ltd. impleaded as respondent no. 10 in O.A. No. 121/2024 did not exist and was accordingly deleted vide order dated 20.01.2026.

Further, it was pointed out that Project Proponent- Kisti (sic Kirti) Paper Mills impleaded as respondent no. 11 in O.A. No. 121/2024 was subsequently renamed as Shakti Paper Mills and vide order dated 24.01.2025 the name of respondent no. 11 was ordered to be corrected accordingly.

It has been pointed out that the correct name of Project Proponent impleaded as respondent no. 11 in O.A. No. 121/2024 is M/s. Shakti Kraft and Tissues instead of Shakti Paper Mills. It has also been pointed out that Shakti Kraft and Tissues, which has been impleaded as respondent no. 11 in O.A. No. 121/2024, has also been impleaded as respondent no. 10 in O.A. No. 269/2024.

In compliance of order dated 28.04.2026 passed by this Tribunal in O.A. No. 121/2024, O.A. No. 269/2024 and O.A. No. 797/2024, the Registry has separated present O.A. No. 437/2026 and separately registered the same against respondent no. 1-Kirti Paper Mills (which has been subsequently renamed as Shakti Kraft and Tissues) with consequential re-numbering of the respondents whereas the Registry has separated O.A. No. 413/2026 and separately registered the same against respondent no. 1- Shakti Kraft and Tissues. Only one case is required to

be registered against respondent no. 1- Shakti Kraft and Tissues and one more separate case is not required to be registered against respondent no. 1- Shakti Kraft and Tissues due to its impleadment in O.A. No. 121/2024 and O.A. No. 269/2024 under different names. Accordingly, orders will be passed by this Tribunal on O.A. No. 413/2026 and separate orders are not required to be passed on O.A. No. 437/2026.

In view of the above, O.A. No. 437/2026 is disposed of as the substantial environmental questions involved will be adjudicated upon by orders to be passed on O.A. No. 413/2026.
