The grievances of the Applicant are illegal cutting of the trees and misappropriation of 500 quintal of wood from the reserved forest area measuring 674 Beehga without following the due process of law. The Forest Department, Government of Rajasthan had prepared a Mauka Panchnama in presence of local villagers on 08.11.2025 and another was prepared qua same issue on 05.11.2025. The bare perusal of Mauka Panchnama dated 05.11.2025 would reveal that 10-15 JCB Machines were uprooting the trees situated upon reserved forest land and the illegal uprooting of the trees and levelling of reserved forest land was being done by Respondent No.11 Peer Mohamad, who was present on spot where the trees were being uprooted and when staff of forest department reached on spot then he ran away along-with the JCB Machines and when the staff of forest department had tried to stop these vehicles then they have not stopped and even tried to harm the forest officials in order to kill them and forest officials had inspected the site where they found that number of trees have been uprooted by the Peer Mohamad by using JCB Machines and also the forest land had been levelled and diverted for non-forest purposes and it has been categorically stated in Mauka Panchnaama that Forester and other subordinate forest officials had tried to contact the Regional Forest Officer concerned but he

remained in moribund condition and did not turn up for taking appropriate action in the matter.

It is further submitted that the Mauka Panchnama dated 08.11.2025 would reveal that number of trees got cut down and uprooted from reserved forest land after getting it levelled by using JCB Machines and in said incident the local forest officers and Peer Mohamad are the actual culprits and the uprooting of the trees was done without there being any authority of law and that too for personal gains and it has also stated in said Panchnama as to how Peer Mohamad had offered the bribe in the tune of Rs.50,000/- to Forest Guard for remaining silent about illegalities which were being committed by them, which shows the active involvement of Peer Mohamad in instant matter along-with other forest officers whose specific roles have been assigned in the Mauka Panchnamas and also the Forest Offence Report has been registered against Peer Mohamad only however the other culprits including the guilty forest officers have been left out despite of having their specific role in alleged incident and as per google map provided by forest department the total affected area is 10.67 Hectare.

It is further argued that the perusal of specific point of inquiry report relating to Regional Forest Officer, Shri Prabhu Ram Dhun and Ms. Payal Mathur, Assistant Conservator of Forests Mandalgarh would reveal that both these officers have not only permitted illegal uprooting of numbers of trees rather they actively participated in entire tale of misappropriation of number of trees

and reserved forest land and even in order to hide their wrong deeds they have prepared a Mauka Panchnama after 31 hours of the incident and that too while sitting in their office and Ms. Payal Mathur had given false and fabricated statements in order to save herself and other culprits from the hands of the law.

Learned Counsel for the Applicant has highlighted the negligence of the forest officials in cutting of the trees knowingly causing loss to the state exchequer to the tune of Rs. 131.86/-lakhs.

Notices were issued to the Respondents and a report was called from the Forest Department.

Learned Counsel for the Respondent/Forest Department, (PCCF), Government of Rajasthan, has submitted that in compliance with the aforesaid directions, a comprehensive action taken report/ factual report was prepared by the Officer-in-Charge & Deputy Conservator of Forests, Office of the Principal Chief Conservator of Forests, Rajasthan, Jaipur, dated 27.03.2026, wherein the sequence of events and action taken has been elaborately recorded, inter alia, as under:-

“ A. Initiation of Inquiry Proceedings

i. Upon receiving complaints regarding large-scale illegal eradication of Prosopis juliflora in areas under the jurisdiction of the Regional Forest Officer, Shahpura, falling within Bhilwara Forest Division, the Deputy Conservator of Forests, Flying Squad, Jaipur was appointed as the preliminary inquiry officer.

ii. The matter also came to light through a news report published in the Bhilwara edition of Dainik Bhaskar dated 08.11.2025.

iii. Upon taking cognizance at the headquarters level, the Chief Conservator of Forests (Vigilance & Inquiry), Jaipur, was appointed as the preliminary inquiry officer for further examination.

B. Field Inspection and Detection of Illegal Cutting: Forest Block Narayanpura Beed (Reserved Forest - Range Asind)

iv. In compliance with the directions of the Chief Conservator of Forests, Ajmer, an inspection was carried out by the Deputy Conservator of Forests, Flying Squad, Ajmer in Range Asind of Bhilwara Forest Division.

v. During inspection, cutting of Prosopis juliflora was found in Forest Block Narayanpura Beed. The total area of Forest Block Narayanpura Beed is 58 hectares, in which cutting was found. Based on this, Shri Rajendra Singh Rawat, Regional Forest Officer, Asind, and Shri Nandlal Gurjar, Forester responsible for the protection of this forest block, were suspended by order No. 6959 dated 12.11.2025 issued by the Chief Conservator of Forests, Ajmer.

C. Field Inspection and Detection of Illegal Cutting: Forest Block Ghas Pilamagara (Protected Forest Range Shahpura)

vi. During the inquiry ordered by the Divisional Chief Conservator of Forests, Jaipur, Shri Anil Kumar Gupta, Deputy Conservator of Forests, Flying Squad, submitted the preliminary inquiry report vide letter No. 585 dated 11.11.2025. In Bhilwara Forest Division, Range Shahpura, Forest Block Beed Ghas Pilanagara, which was notified as a protected forest area on 22.12.1955 and has an area of 481.46 acres was inspected by Assistant Conservator of Forests, Mandalgarh, Ms. Payal Mathur, along with the

D. Fixation of Responsibility: Ghas Pilamagara (Protected Forest)

In the preliminary inquiry conducted by the Deputy Conservator of Forests, Flying Squad, Jaipur, responsibility for the cutting in the affected 10.67 hectares of Forest Block Ghas Pilamagara was attributed to Shri Prabhuram Dhun, Regional Forest Officer, Shahpura, and Ms. Payal Mathur, Assistant Conservator of Forests, Mandalgarh.

viii. The Deputy Conservator of Forests, Flying Squad, Jaipur also submitted a report regarding Forest Block Narayanpura Beed of Asind Range. As per the report, Shri Nandlal Gurjar (Forester, Asind), Shri Rajendra Singh Rawat (Regional Forest Officer, Asind), and Ms. Munni (Assistant Conservator of Forests, Bhilwara) were found responsible.

F. Departmental Action Taken

ix. Acting upon the findings, the Chief Conservator of Forests, Ajmer, by order No. 6827-35 dated 09.11.2025, suspended Shri Prabhuram Dhun (Regional Forest Officer), Shri Shankar Lal Mali (Forester, Naka In-charge, Shahpura), and Shri Vishram Meena (Forester In-charge, Forest Block Pilamagara) for illegal cutting in Forest Block Ghas Pilamagara under Shahpura Range.

x. At the headquarters level, for investigation of the matter, a letter No. 1739 dated 14.11.2025 was sent to the Director General, Anti-Corruption Bureau, Rajasthan, Jaipur.

By State Government Order No. 29598 dated 20.11.2025, Shri Gaurav Garg, Deputy Conservator of Forests (IFS), Ms. Payal Mathur (Assistant Conservator of Forests, Mandalgarh), and Ms. Munni (Assistant Conservator of Forests, Bhilwara) were suspended vide State Government Order No. 8599113 dated 20.11.2025.

G. Ongoing Proceedings

xii. It is submitted that disciplinary proceedings, including issuance of charge sheets against all suspended officers and officials, are presently under progress.”

It is further argued that the Forest Block Narayanpura Beed, situated in Range Asind, Bhilwara Forest Division, is a duly notified Reserved Forest (notification dated 27.04.1949, area 270 bighas). Wegal cutting was detected therein, and immediate and appropriate administrative action, including suspension and initiation of disciplinary proceedings against responsible officials, has already been undertaken and that any allegation of inaction is therefore, incorrect and denied and further that the Divisional Chief Conservator of Forests, Jaipur, had duly ordered an inquiry into illegal cutting in Shahpura Range, and the inquiry officer conducted investigation based not only onsite inspections but also on confidential inputs received during the course of inquiry, which is in accordance with established administrative procedure.

registered by the Forest Department in respect of illegal felling and uprooting of trees in Forest Block Pilamangra (Borda Bawariyan), falling under Shahpura Range, Bhilwara Forest Division. It is submitted that the Deputy Conservator of Forests, Bhilwara, vide letter dated 15.01.2026, forwarded the status report received from the Superintendent of Police, Bhilwara to the higher authorities. As per the said report, investigation has been actively carried out by the police authorities, wherein multiple accused persons have been dentified and apprehended, and further investigation is in progress. The report also reflects that the illegal activities were carried out using heavy machinery and involved organized action, and necessary legal proceedings under the applicable provisions of law have been initiated.

The order suspending the official concerned and the order issued by the Principal Chief Conservator of Forest with regard to the referring the matter to the corruption bureau have been filed which are as follows:-

के बीड पीला मगरा 195 हैक्टेर्र में व्यापक पैमाने पर जूलीफ्लोरा दविोहन के संिेश एवं उक्त दविोहन से संबंदधत फोटोग्राफ्स प्राप्त होने पर प्रकरर् में प्रारस्थिक जांच उप वन संरक्षक, गश्तीिल, जर्पुर से करार्ी गर्ी।

उप वन संरक्षक, गश्तीिल, जर्पुर द्वारा प्रस्ु प्रारस्थिक जांच के तथ्ों एवं दनष्कषों से त र्ह दवदित होता है दक क्षेत्ीर् वन अदधकारी एवं उत्तरोतर उच्च अदधकाररर्ों के सदनध्य में बीड पीला मगरा में दिनांक 04.11.2025 की मध्य रादत् से दिनांक 05.11.2025 तक की सुबह से पूवा संरदक्षत वन क्षेत् में खडी वन सम्पिा प्रोसोदपस जूलीफ्लोरा का दनर्म दवरूद्ध तरीके से अवैध कटान दकर्ा गर्ा हैं। उप वन संरक्षक, गश्तीिल, जर्पुर द्वारा उक्त लोकसेवकों एवं ग्रामीर्ों के साथ मौका दनरीक्षर् उपरान्त मौका पंचनामा कार्म करते हुर्े िन अपराध िजा कर प्रारस्थिक सूचना ररपोटा िजा कर समस्त अदभलेख क्षेत्ीर् वन अदधकारी, शाहपुरा को सुपुिा करने की कार्ावाही की गर्ी है। क्षेत्ीर् वन अदधकारी, शाहपुरा एवं सहार्क वन संरक्षक, माण्डलगढ़ के अवांदित िबाब एवं वन अपरादधर्ों के दवरूद्ध कार्ावाही करने में असहर्ोग होना पार्ा गर्ा। अनुसंधान के िौरान उक्त िोनों अदधकाररर्ों के िजा िथानों में अंदकत तथ्ों के दमथ्ा होने एवं कूट रदचत अदभलेख तैर्ार करने के कुस्थित प् र ास भी पररलदक्षत हुए है दजन्हें उप वन संरक्षक, गश्तीिल, जर्पुर द्वारा बर्ानों एवं साक्ष्ों के आधार पर प्रमादर्त होना पार्ा गर्ा है। प्रारस्थिक जांच ररपोटा के अनुसार प्रकरर् में िजा प्रारस्थिक सूचना ररपोटा में नामजि आरोपी पीर मोहम्मि के क्षेत्ीर् र्न अदधकारी कार्ाालर् शाहपुरा एवं कार्ाालर् उप वन संरक्षक, भीलवाडा पररसर में बार-बार उपस्थित होने के तथ् भी पररलदक्षत हुए है, दजसके आधार पर प्रगादर्त होता है दक आरोपी पीर मोहम्मि के द्वारा क्षेत्ीर् वन अदधकारी, शाहपुरा एवं सहार्क वन संरक्षक, माण्डलगढ़ के दनरन्तर संपका में रहते हुए इनकी दमलीभगत से वन अपराध काररत दकर्ा गर्ा है।

उप वन संरक्षक, गश्तीिल, जर्पुर को जांच कार्ावाही के िौरान क्षेत्ीर् वन अदधकारी, आसीन्द से संबंदधत कार्ािल बीड नारार्र्पुरा में भी प्रोसोदपस जूलीफ्लोरा के अवैध कटान की जानकारी दमलने पर उक्त क्षेत् के भ्रमर् करने पर वन क्षेत् से बीड नारार्र्पुरा से प्रोसोदपस जूलीपलोरा के बीट प्रभारी, नाका प्रभारी एवं क्षेत्ीर् वन अदधकारी, आसीन्द एवं दमलीभगत से अवैध कटान के साक्ष् पार्े गर्े दजससे संबंदधत साक्ष् भी प्रारस्थिक जांच प्रदतवेिन में पृथक् से सस्थम्मदलत हैं।

उपरोक्त दवषर्ान्तगात एवं प्रासंदगक पत् के संिभा में दनवेिन हैं दक दिनांक 20.11.2025 को प्राथी श्री आदबि खां कार्मखानी दपता अर्ुब खां कार्मखानी उम्र 39 साल दनवासी माण्डल गेट बनेडा हाल सहार्क वनपाल वनपाल नाका शाहपुरा थाना शाठपुरा दजला भीलवाडा ने उपस्थित धाना होकर एक दलस्थखत ररपोटा इस आशर् की पेश की दक दिनांक 05.11.2025 को इस कार्ाालर् ऑदफस नाका शाहपुरा के अन्तगात ग्राम पंचार्त बोरडा बावररर्ान के नजिीक घास बीड पीला मगरा बीट प्रभारी शंकर लाल माली द्वारा सुबह 7 बजे सूचना िी गई दक धारा बीड पीला मगरा में अवैध रूप से दवलार्ती बंजूल को जे सी बी द्वारा टूठ सदहत दनकालने की सूचना दमलते ही वनपाल बाका प्रभारी शाहपुरा श्री दवश्राम मीर्ा के फोन करने पर मैं दडकोला नाके से खाना होकर मौके पर पहुंचा उसके उपरांत हमारे स्टाफ द्वारा लगभग 15 जेसीबी को रोकने का प् र ास दकर्ा गर्ा लेदकन जबरन स्टाफ से झगडा मारपीट करते हुर्े जेसीबी को घास बीढ़ पीला मगरा से भगाकर ले गर्े मौके पर मुख्य आरोपी पीर मोहम्मि पुत् श्री अब्दुल पठान दनवासी वैरवा मोहल्ला खातनखेडी के रूप में पहचान की गर्ी जो दक काले कलर की स्कॉदपार्ों दजसके गाडी नं. आर जे 08-र्ूए-6058 में एवं इनके अन्य साथी गाडी नम्बर आर जे 06 सी एफ 4637 में स्टाफ के साथ जबरन धक्का मुक्की कर उक्त गाडी में बैठकर भाग गर्े मौके पर बीड पीला मगरा में अवैध रूप से कटान का नुकसान 8-10 हैक्टेर्र में उक्त आरोदपर्ों द्वारा कर दिर्ा गर्ा है मौके पर कार्ावाही करने हेतु श्री

िौराने अनुसंधान प्राथी व गवाहान के लेखबद्ध कर घटना िल का दनरीक्षर् दकर्ा जाकर पहुंच वन दवभाग की भूदम दपला गंगरा तंगल से उखाडे गर्े बबूल को फिा मुदताब दकर्ा गर्ा। प्रकरर् में गुस्थिमान 01. बाबू मोहम्मि दपता श्री अहमि खां जादत पठान मुसलमान उम्र 41 साल दनवासी दनम्बाहेडा कला थाना बनेडा दजला भीलवाडा 02. श्री पीर मोहम्मि पठान पुत् अब्दुल खा पठान उभ 31 साल दनवासी खातनखेडी पुदलस थाना बनेडा दजला मीलवाडा 03 रफीक खााँ पठान पुत् हबीब खॉ पठान उम्र 40 साल जाती पठान मुसलमान दनवासी खातन खेडी थाना बनेडा दजला भीलवाडा 04. श्री भवंर भील पुत् उगमा भील उम्र 35 साल जाती भील दनवासी िेवा का खेडा धामदर्र्ा थाना रार्ला दजला भीलवाडा के दवरूद्ध धारा 121, (1) 132, 61(2), 62,303 (2) वी एन एस व 3 पीडीपीपी एक्ट का अपराध प्रमादर्त पार्ा जाने से दगरफतार दकर्ा जा चुका है। प्रकरर् में शेष गुस्थिमान की तलाश जारी हैं।

प्रकरर् में अब तक के अनुसंधान एवं मुस्थिमान से पुिताि एव पत्ावली पर उपलब्ध साक्ष्ों से र्ह तथ् सामने आर्े दक मुस्थिम पीर मोहम्मि के मोबाईल नम्बर 8000384574 से क्षेदत्र् वन अदधकारी प्रभु लाल धूर् के मोबाईल नम्बर 8107409664 पर दिनांक 15.10.25 से 18.10.2025 तक कुल 15 कॉल होकर आपस में वाताालाप होना पार्ा गर्ा है साथ ही मुस्थिम पीर मोहम्मि द्वारा दिनांक 04.11.25 को क्षेदत्र् वन अदधकारी प्रभु लाल धूर् को 60 लाख रूपर्े नगि रूपर्े िेना बतार्ा है। एवं मुस्थिम पीर मोहम्मि के मोबाईल नम्बर 8000384574 से सहार्क वनपाल श्री शंकर लाल माली के मोवाईल नम्बर 9214540462 पर दिनांक 15.10.25 से दिनांक 04.11.2025 तक कुल 10 बार आपस में वाताा हुई है दजससे शंकर लाल माली सहार्क वन पाल की भी संदलप् त ा है। प्रकरर् अनुसंधान से क्षेदत्र् वन अदधकारी प्रभु लाल धूर् व सहार्क वन पाल श्री शंकर लाल माली का आचरर् संस्थद्धग्ध होना पार्ा गर्ा।

प्रकरर् में पुदलस अधीक्षक, भ्रष्टाचार दनरोधक ब्यूरों, रेंज अजमेर को अदग्रम दवदधक कार्ावाही हेतु इस कार्ाालर् के पत्ांक 898-99 दिनांक 08.01.2026 से प्रेदषत दकर्ा गर्ा की प्रदत संलग्न हैं।

The same matter was taken up by the Principal Bench of this Tribunal in O.A. No.171/2025(CZ) and after taking cognizance, the matter was referred to this Bench. Since both the matters are connected matters with regard to the same incident, thus, both the cases are decided by a common order.

We have examined the report submitted by the Forest Department and copy of the order issued by the Forest Department, which discloses that proper disciplinary enquiry has been initiated and the officials found guilty have been suspended. The First Information Report (FIR) has been lodged and matter is under investigation before the Anti-Corruption Bureau and after the initiation of the departmental enquiry and after lodging of FIR during the vigilance enquiry, it would not be appropriate to intervene in the matter.

However, we direct the Principal Chief Conservator of Forest, Rajasthan, to monitor it and to ensure that the guilty person(s) must be dealt with in accordance with rules and to ensure that no further incident may occur within his jurisdiction. The matter will be finally dealt with in accordance with the final departmental enquiry and departmental action and the enquiry report conducted by the Forest Department or the Anti-Corruption Bureau. There is no need to further intervene by this Tribunal by any order.
