In this Original Application (OA), the Applicant has challenged the no objection certificate dated 13.06.2025 issued by the District Magistrate, Haridwar in respect of the establishment of the petroleum filling stations at Khasra No. 3, Khatauni 00005, Survey No. 358-23-24, Town/Village Sultanpur Majri, Tehsil and Haridwar, State of Uttarakhand by the Respondent No. 4.

The main grievance of the Applicant is that the petrol pump is being set up in violation of the siting criteria which have been prescribed by the CPCB in the Guidelines dated 07.01.2020 as amended on 16.08.2021 and the Government of Uttarakhand notification/order dated 05.10.2021.

The implementation of the Guidelines is required to be ensured by the concerned PCB. Hon’ble Supreme Court in the matter of Indian Oil Corporation Ltd. v. V.B.R. Menon reported in [(2023) 7 SCC 368 while modifying the order of the Tribunal had directed as under:

“53.2. We set aside the directions issued by NGT in the impugned order as contained in paras 69(iii) and (iv). Instead, we direct CPCB to instruct all the State Pollution Control Boards to ensure that the guidelines issued by it vide the Office Memorandum dated 7-1-2020 are strictly adhered to. If there is breach of any of the guidelines issued by CPCB vide Office Memorandum dated 7-1-2020, then the State Pollution Control Board concerned shall proceed against the erring outlet in accordance with law at the earliest.”

In terms of the above judgement, the above Guidelines are required to be strictly adhered to and the State PCBs have been entrusted with the responsibility to ensure the same. Hence, we dispose of the OA granting liberty to the Applicant to make a complaint to the Respondent No. 3- Member Secretary, UK PCB enclosing therewith all the relevant material showing violation of the siting criteria prescribed in the CPCB Guideline. The Respondent No. 3 on receipt of such a complaint will get the spot verification done as expeditiously as possible preferable within six weeks from the date of receipt of the complaint and will ensure that the retail outlet is set up strictly in accordance with the CPCB Guidelines
