This original application was registered on the basis of the letter petition wherein certain news item were enclosed regarding illegal operation of several units of jeans dyeing, powder coating and other metal melting in densely populated residential area within narrow streets near Mohan Halwai Wali Gali, Ward No. 20, Gagan Vihar, Ghaziabad. The Applicant had alleged that several such units were operating in that area, but action was taken only against one unit.

The Tribunal by the order dated 24.02.2026 had impleaded the concerned respondents and had issued notices to them.

The Respondent No. 2, District Magistrate, Ghaziabad has filed the response affidavit dated 12.05.2026 disclosing that six such illegal units were found and these units have been sealed and communication has been sent for disconnecting the electricity of these units. The details disclosed in the affidavit of the Respondent No. 2 are as under:

6. That the inspection of alleged sites was carried out by UPPCB officials on 29.04.2026 upto ascertain the truthfulness of allegations.

7. That during inspection, a total of 06 illegal industrial units comprising:

02 jeans washing units, 03 powder coating units and 01 melting furnace unit

were found operating at Khasra No. 554 & 555, D-Block, Mohan Halwai Wali Gali, Gagan Vihar, Ghaziabad. Local inquiry revealed that the said activities were being carried out on a jobwork basis in residential premises without obtaining Consent to Operate (CTO) from the UPPCB. That before the UPPCB officials reached the sites, the unit operators locked the premises and absconded. Accordingly, all the premises were sealed by the UPPCB with the assistance of the local police.

A Copy of the Inspection report and photographs have been annexed herewith as ANNEXURE R-1.

8. That it was further observed that all the aforesaid units were operating in a non-conforming/residential area where Consent to Operate (CTO) is not granted by the UPPCB. Local inquiry further revealed that the said illegal units were being operated from rented residential premises.

That further it is relevant to mention that Deponent vide letter dated 23.03.2026 has formed a Committee regarding surveying/sealing/electricity disconnection of illegal units operating in residential area of Tehsil Loni, District Ghaziabad and action is being taken by Committee from time to time. Copy of letter dated 23.03.2026 is attached with ANNEXURE R-1 as Annexure-I.

10. That UPPCB Ghaziabad has also written a letter to Electricity Department on dated 07.05.2026 requesting disconnection of electricity of these illegal units operating in residential area of Mohan Halwai Wali Gali, Ward no. 20, Gagan Vihar Ghaziabad.

A Copy of the letter dt. 07.05.2026 has been annexed with ANNEXURE R-1 as Annexure-II.”

The action taken report has also been placed on record which discloses the details of the units against which action has been taken and that these units were operating without the requisite permissions from the PCB. Alongwith the report, the photographs have been enclosed showing that these units have been sealed. Annexure-2 to this report is a communication which was sent to the electricity company on 07.05.2026 for disconnecting the electricity of these units.

Learned Counsel for the Respondent No. 2, on instructions, has informed that subsequently the electricity of these illegally operating units has been disconnected.

Having regard to the above, we find that the needful has been done to redress the grievance raised in the letter petition. Hence, compliance report filed by the Respondent No. 2 is taken on record. The District Administration will carry out the regular monitoring of the area concerned to ensure that such units do not illegally operate in the area.
