Ms. Tripti Goswami has sent the present letter petition through Speed Post dated 10.03.2026 to this Tribunal, which has been treated and registered as Original Application (O.A.) No.142/2026/EZ for exercise of suo-motu jurisdiction in view of law laid down by Hon’ble Supreme Court in Municipal Corporation of Greater Mumbai Versus Ankita Sinha and others, (2022) 13 SCC 401 .

The applicant has raised grievances regarding conversion of Doba land into Vastu land by the Kolkata Municipal Corporation. The relevant part of the letter petition enumerating grievances of the applicant is reproduced as below:-

“ Subject: Please Take the necessary action for all ILLEGAL WORK which is created by the Kolkata Municipal Corporation that some ‘DOBA’ land which is trying to change the land to ‘VASTU’ land .

I. Ms. Tripti Goswami D/O Sri. Barun Goswami (who is a Senior Citizen and also Disable person) of 18A, R. N. Das P.S. Garfa Kolkata- 700031 submitted the letters for the above

illegal works to some officers to the K.M.C. which enclosed here with.

Sir, I am surprised that there is no improvement against my complaint.

The above land is situated at 52/A Or 52 A, R.N. Das Road P.S. Garfa.

The promotor is trying the DOBA converted to VASTU land by the some staff of the K.M.C. and also some antisocial aliments.

Hope, please take the necessary action as earliest.”

The O.A. was taken up for hearing on 02.07.2026, on which date the applicant did not appear personally or through authorized representative/counsel on which the Registry was directed to issue notice to the applicant to appear physically or through VC and to produce the material available with her in support of the averments made in the O.A. before this Tribunal on the next date of hearing fixed.

Despite such information, the applicant has not appeared before this Tribunal today personally or through any authorized representative/counsel and no material has been placed on record.

However, in view of the nature and magnitude of alleged environmental allegations and also substantial environmental questions involved, we consider it appropriate to proceed further instead of dismissing the O.A. in default for non-prosecution.

We have gone through the O.A. and the documents attached with the same.

The averments made in the O.A. raise substantial questions relating to environment arising out of the implementation of the enactments specified in Schedule-I to the National Green Tribunal Act, 2010.

In view of the averments made in the O.A., we consider it necessary to get the factual position verified by constituting a Joint Committee comprising the representatives of the concerned authorities

which are also under statutory obligation to take appropriate remedial action on the basis thereof.

Accordingly, we constitute a Joint Committee comprising of representatives of the District Magistrate, South 24 Parganas, West Bengal, the Commissioner, Kolkata Municipal Corporation, and the Regional Officer, West Bengal Pollution Control Board, South 24 Parganas and direct the same to undertake visits to the site, look into the grievances of the applicant, associate the applicant and representative of the concerned project proponent, verify the factual position and suggest appropriate remedial action.

The Joint Committee is directed to submit its report, within two months from the date of receipt of copy of this Order, before Registrar, Eastern Zone Bench at Kolkata and to send a copy of the report to the concerned authorities who shall be bound to take appropriate action in accordance with law and Principles of Natural Justice by giving opportunity of being heard to the concerned project proponent within next two months from the date of receipt of a copy of the report of the Joint Committee and to file action taken report before learned Registrar, Eastern Zone Bench at Kolkata within next one month .

The District Magistrate, South 24 Parganas, West Bengal will be the nodal agency for coordination and compliance regarding submission of the reports of the Joint Committee and filing of action taken reports by the concerned authorities.

The Registrar, Eastern Zone Bench at Kolkata may place the matter before the Bench if reports are not filed as directed above and also if on receipt of the reports further orders are considered to be necessary.

The present original application is disposed of accordingly.

A copy of this order may be sent to the Member Secretary, West Bengal Pollution Control Board, the District Magistrate, South 24 Parganas, West Bengal, the Commissioner, Kolkata Municipal Corporation and the Regional Officer, West Bengal Pollution Control Board, South 24 Parganas by email for requisite compliance.
