This MA is registered on the basis of the report dated 18.03.2026 filed by the Uttarakhand PCB in OA No. 68/2023. In the OA the issue of discharge of waste ( कड़ ू ा ू , कचऱ ा ) in Saryu Nadi at Sera Ghat in District Almora was raised and OA was disposed of with a direction to file the factual status report through email with the Registrar General.

In terms of Solid Waste Management Rules, 2006 and the order of the Hon’ble Supreme Court in Civil Appeal No. 6174/2023, Bhopal Municipal Corporation v. Dr. Subhash C. Pandey & Ors . it is the District Magistrate which has been entrusted with the responsibility to ensure the implementation of SWM Rules, 2006. Therefore, the District Magistrate is required to respond to the remedial action which has been taken. The report dated 18.03.2026 filed by the Uttarakhand PCB discloses that the inspection of banks of Saryu river flowing through Sera Ghat was conducted on 27.02.2026 and following status was found:-

“4. That in compliance with the order passed by this Learned Tribunal and pursuant to Board Headquarters Letter No. 1884 dated 23.02.2026, an inspection of the banks of the Saryu River flowing through Seraghat was conducted on 27.02.2026. The findings of the inspection are as follows:

a. That approximately 12-13 residential / commercial shops are situated in District Almora, and 2-3 residential buildings and office buildings are situated near the riverbank in District Pithoragarh.

b. That during the inspection of the sites, a Solid Waste Collection Shed was found established in District Pithoragarh for the collection of municipal waste. However, no proper arrangement for the disposal or collection of municipal waste was found in District Almora.

c. That during the inspection at Seraghat, municipal solid waste was found scattered at certain locations towards the riverbank. However, it was informed by the residents that the waste is collected and disposed of on a weekly basis by the Zila Panchayat Almora through a waste collection vehicle.

d. That the disposal of sewage by the residential and commercial establishments located on the banks of the Saryu River in Seraghat is carried out through septic tanks / soak pits. During the inspection, no direct discharge of sewage flowing towards the riverbank was observed.

e. That during the inspection, a water sample was collected from the downstream of the Saryu River and analysed. As per the analysis report, the water quality of the river meets the Designated Best Use (DBU) Water Quality Class-B, as prescribed by the Central Pollution Control Board.

f. That the Saryu River originates from District Bageshwar and ultimately joins the Sharda River. The monthly monitoring of the water quality of the Saryu River is conducted by the State Board at the downstream of Bageshwar (upstream of Seraghat). As per the monitoring report, the water quality meets the Designated Best Use (DBU) Water Quality Class-B, as prescribed by the Central Pollution Control Board.”

The District Magistrate Almora is required to look into the above aspect and file the status report disclosing the remedial and punitive action with the Registrar General of the Tribunal through email at [email protected]. Let the same be filed within three months.
