This MA has been registered on the basis of the Affidavit dated 20.02.2026 filed on behalf of the Respondent No. 1-NTPC in terms of the order of the Hon’ble Supreme Court dated 21.07.2020 passed in Civil Appeal No. 2728/2020. The timeline was extended for setting up FGD plant in terms of the CPCB notification dated 11.12.2017 and with regard to tarpaulin covering of coal wagons further one month time was granted from 21.07.2025. Thereafter, from time to time the Respondent No. 1 had approached the Hon’ble Supreme Court seeking extension of time to set up FGD plant.

The report reveals that work of setting up FGD plant in unit no. 1,2 and 3 have been completed on 27.06.2024, 03.09.2024 and 06.05.2024. So far as the work of setting up FGD plant in unit no. 4 and 5 is concerned, the Hon’ble Supreme Court vide order dated 08.12.2025 passed in MA No.

2592/2025 in Civil Appeal No. 2728/2020 has extended it upto 31.12.2026.

The present report has been filed in terms of the order dated 21.07.2020 passed by the Hon’ble Supreme Court of India and Civil Appeal No. 2728/2020 read with order dated 28.02.2022 passed by the Hon’ble Supreme Court in M.A. No. 276/2023, M.A No.1719/2023, M.A. No.1165/2024 and M.A. No. 2592/2025 in Civil Appeal No. 2728/2020. Affidavit of the respondent No. 1 dated 20.02.2026 discloses the progress as under:-

“1. That I am the Authorised Representative of the Respondent No.1 in the above captioned matter and as such I am well conversant with the facts and circumstances of the case and hence, I am competent to swear the present affidavit.

2. That vide Order dated 27.02.2020, this Hon'ble Tribunal had directed the NTPC Ltd. to install the FGD plant at its Sipat Unit within a period of 6 months and to ensure to Tarpaulin covering of Coal wagons within one month from the date of the order.

3. I state that the order dated 27.02.2020 passed in O.A. No. 459 was challenged by the NTPC Ltd. before the Hon'ble Supreme Court of India in Civil Appeal No. 2728 of 2020. Vide the order dated 21.07.2020, the Hon'ble Supreme Court of India disposed-off the Appeal by extending the timelines for compliance as follows:

i. For setting up of FGD plant, the timelines were extended in terms of the CPCB notification dated 11.12.2017.

ii. With regard to the Tarpaulin covering of the wagons, a further one month time was granted from 21.07.2020.

That the Hon'ble Supreme Court has, from to time, been extending the timelines for setting-up of the FGD plants and previously, the timeline for completing the FGD plant installation in Units I, 2 and 3 were extended till June, 2024. In respect of Unit Nos. 4 & 5 also, the timelines were extended till 30th June, 2024 vide order dated 18.04.2022 passed in MA No. 47612022. That while extending the period for installation of FGD Aplant, the Hon'ble Supreme Court had also directed the Respondent No.1/NTPC Ltd. to file quarterly progress report before this Hon'ble Tribunal. This direction was reiterated in orders passed subsequently.

5. That the works in Units 1, 2 & 3 have been completed on 27.06.2024, 03.09.2024 and 06.05.2024, respectively.

6. That since the works could not be completed in Unit No.2 of Stage-I and Unit Nos. 4 & 5 of the Stage-II, in terms of the order dated 18.04.2022, an application seeking extension of time in respect of those Units was filed before the Hon'ble Supreme Court vide M.A. No.

11651/2024. The same has been allowed by the Hon'ble Supreme Court on 18.11.2024, and the time for completion of Stage-2 FGD system (comprising of Unit Nos. 4 and 5) was extended till August, 2025.

Thereafter, the Respondent No. 1 has installed and commissioned FGD in units 1, 2, 3 and got further extension from the Hon'ble Supreme Court vide Order dated 18.12.2025 in MA No. 2592 of 2025 in Civil Appeal No. 2728 of 2020 for completion of Stage-2 FGD system (comprising of Unit Nos. 4 and 5) upto 31st December, 2026.”
