The Times of India dated 15.04.2026 highlighted the boiler blast at Vedanta Power Plant in Chhattisgarh causing death of more than 13 persons. The brief facts as narrated in the news reporting are that a powerful boiler blast at Vedanta Limited Thermal Power Plant in Chhattisgarh's Sakti District on Tuesday left at least 13 workers dead and 21 others severely injured in one of the worst industrial accidents in the State in recent years.

The possibility of the toll rising, as several victims are in critical condition. The explosion occurred around 2:30 pm at Unit No.01 in the plant, located in Singhitarai Village triggering panic and confusion. The explosion was likely caused by a tube rupture that led to a high-pressure steam leak before triggering a blast in the coal fired boiler system. It is reported that more than 34 workers had suffered severe burns of whom, 1

13 succumbed while 21 are under treatment. The plant with an installed capacity of 1200 MW, had routine operations under way when the blast occurred.

The cognizance of the matter was taken up by the Tribunal and notices were issued to the Respondents to submit the reply. The replies have been filed.

We have heard the learned Counsel for the parties and perused the records.

¶19

Submissions of the learned Counsel for the Respondent No.3/Chhattisgarh Environment Conservation Board (CECB), are that the MoEF&CC vide letter dated 06.01.2024 accorded Environmental Clearance (EC) for the project activity 1(d) Thermal power plant (2 X 600 MW) and 8(b) Township / area development project on the name of M/s Athena Chhattisgarh Power Ltd, Janjgir-Champa, CG. The EC is valid up to 05.01.2034. The unit had submitted a six-monthly compliance report of EC dated 16.05.2026 for the period of October 2025-March 2026 in accordance with EC conditions. The Respondent No.4 unit had obtained the Consent to Establish vide letter dated 09.05.2024 and also obtained the Consent to Operate from Respondent Board, which is valid up to 28.02.2027. The unit submitted an application to the Respondent Board on 03.10.2024 for change of the unit’s name. Accordingly, the name of the unit had been changed from M/s Athena Chhattisgarh Power Ltd to M/s Vedanta Limited, Chhattisgarh Thermal Power Plant vide letter no. 6837 dated 29.10.2024. The Respondent No. 4 unit had obtained authorization under the Hazardous and Other Wastes (Management & Transboundary Movement) Rules, 2016 from the Respondent Board vide letter dated 01.08.2025, which is valid till 31.07.2030. The Respondent No. 4 unit had also obtained permission for

water withdrawal of 28 MCM/year from Mironi barrage of Mahanadi from the Water Resource Department, Raipur vide letter dated 01.05.2025, and permission is valid up to 16.07.2055. The Respondent No. 4 unit had obtained a license to operate the factory from the Government of Chhattisgarh vide License No. 7336 dated 29.11.2025. As per the license conditions, the maximum permissible number of workers for 1200 MW production is 1300. he Respondent No. 4 unit had obtained a certificate for use of boiler from the Government of Chhattisgarh, Boiler Inspection Department, vide Certificate No. 224131730866 dated 11.07.2025, valid up to 08.07.2026. As per the hydraulic test conducted on 09.07.2024 up to 235 kg/cm², it is mentioned in the certificate that the boiler can operate at a maximum pressure of 188.7 kg/cm².

It is further argued that after the incident occurred, a meeting on the same day (14.04.2026) was convened in the presence of District Collector, Superintendent of Police, Additional SP, SDM Dabhra, Senior Plant Management, Hon’ble MLA of Chandrapur area and other stakeholders to discuss about the accident and related issues including the treatment, relief measures, compensation and employment on compassionate ground etc. to the concerned workers. Further, a spot agreement was made with respect to the compensation to deceased and injured persons, and employment to dependents of deceased as per policy. It was decided to disbursed ex-gratia compensation of ₹15,00,000/- (Rupees Fifteen Lakh only) to each injured worker and exgratia amount of ₹35,00,000/- (Rupees Thirty-Five Lakh only) to the next of kin (nominee) of each deceased workman by the company. It is pertinent to mention here that these payments have been made in addition to, and over and above, the statutory entitlements payable to the workmen by their respective employers under the applicable laws. is further submitted that an ex-gratia payment of ₹5,00,000/- to the family of each deceased person and ₹50,000/- to each injured person was announced by Hon'ble Chief Minister of Chhattisgarh. In this regard, the Office of State Government sought necessary information of deceased and injured persons from the Office of District Collector, Sakti. The required information was provided by the Office of District Collector; Sakti vide letter dated 18.06.2026 for further disbursal of the compensation. After considering the factual position noticed during the inspection the Joint Committee recommended the following to be implemented by Respondent No.4 unit for the improvement:-

“i. The Respondent No.4 Unit shall ensure compliance with the recommendations of the Central Government Boiler Inquiry Committee and submit a time-bound Action Taken Report (ATR) to the concerned regulatory authorities before recommencement of operations.

ii. The District Collector and the Respondent No. 4 unit management shall coordinate with the concerned State and Central Government agencies to ensure timely disbursement of compensation and all applicable statutory benefits, including those under ESIC, EPF, and other eligible welfare schemes/insurances, to the families of injured/deceased persons.

iii. The Respondent No. 4 Unit shall strengthen preventive maintenance and condition monitoring of boilers, pressure parts, fans, instrumentation and safety interlocks to minimize the risk of catastrophic process failures.

iv. The Distributed Control System (DCS), Burner Management System (BMS), Master Fuel Trip (MFT) and other critical safety interlocks shall be periodically tested and validated to ensure safe boiler operation.

v. Contractor safety management shall be strengthened through competency-based training, work permit systems, hazard communication and continuous supervision during high-risk activities.

vi. The Respondent No. 4 unit shall revise its On-site Emergency Plan and Disaster Management Plan incorporating lessons learnt from the

present incident and conduct periodic mock drills involving district administration and emergency response agencies.

vii. Although no significant off-site environmental impact was observed, the Respondent No. 4 Unit shall undertake enhanced monitoring of ambient air quality, water quality and soil quality for a suitable period after recommencement of operations and submit compliance reports to Respondent Board in accordance with CTO and EC conditions.

viii. The Respondent No. 4 Unit shall ensure strict compliance with the provisions of the Environment (Protection) Act, 1986, Air (Prevention and Control of Pollution) Act, 1981, Water (Prevention and Control of Pollution) Act, 1974, Boilers Act, 2025, and other applicable environmental and industrial safety regulations.

ix. The Respondent No. 4 Unit shall continue rehabilitation measures, including compassionate employment, medical support, counselling session, motivation programs and welfare assistance to the affected families, until all commitments are fulfilled. Nodal officer appointed by the Respondent No. 4 unit shall coordinate with the families of injured/deceased address the needs of the family members.

x. Any temporary bypass, inhibition or forcing of Boiler Protection System interlocks, Master Fuel Trip logic or other critical safety functions shall be permitted only under a documented authorization procedure approved by the competent operating authority. All temporary overrides shall be removed immediately after completion of the intended activity, and the affected protection functions shall be functionally tested before restoration of normal boiler operation.

xi. The Sequence of Events (SOE) recording system shall be maintained properly to ensure accurate recording of all operational events, alarms, trips and interlocks for effective monitoring and incident analysis.

xii. The boiler control and protection system shall incorporate automatic interlocks to ensure that, following any Master Fuel Trip, mill trip or furnace trip, no fuel admission, burner light-up or coal mill operation is permitted until the furnace has been completely purged in accordance with the OEM-prescribed purge requirements and approved operating procedures.

xiii. The Respondent No. 4 unit may install online O2, CO, CO2, NO, and SO2 at Air Pre Heaters inlet and outlet to monitor the process variations.

xiv. Chief Inspector of Boilers, Chhattisgarh & Chief inspector of Factories, Chhattisgarh may issue an advisory to all coal-based thermal power plants to review combustion safety systems, boiler protection philosophy, emergency operating procedures and process safety practices to prevent recurrence of similar incidents.”

The learned Counsel for the Respondent No.4 has filed the reply against the I.A. No.98/2026. By means of this application, the Enquiry Officer has been called to submit the report or for impleading as a party but the Applicant/Respondent No.3 has not pressed this application. Thus, I.A. No.98/2026 stands disposed of as not pressed.

Learned Counsel for the Respondent/Project Proponent has submitted that periodical half yearly Environmental Clearance compliances are being regularly sent to the competent authority in which all the environmental conditions as complied and were examined by the competent authority.

The matter was examined by the Enquiry Committee constituted by the Department for Promotion of Industry and Internal Trade (DPIIT), Ministry of Commerce & Industry, Govt. of India, New Delhi. The technical adviser, Chief Inspector of Boiler, Chhattisgarh, General Manager, Quality and Plant Labs, Bharat Heavy Electricals Limited, Deputy Director, Central Electricity Authority, Director of Steam Boilers, Additional Chief Engineer, Atal Bihari Vajpayee Thermal Power Station, Marwa, C.G., Joint Director, Central Power Research Institute, Nagpur, were the members of the committee and they have submitted the finding and test report as follows:-

Summary of Observations

¶54

The failed downcomer supply pipe samples exhibited severe localized internal damage near the tube/header junction region. The failed regions showed localized wall thinning, irregular rupture edges and directional flow marks along the ID surface, indicating progressive internal material loss during service.

1. Chemical composition analysis using Optical Emission Spectroscopy (OES) confirmed that the chemical composition of both failed tube samples satisfied the requirements of ASME SA106 Gr C specification. No significant deviation in alloying elements was observed.

¶56

2. Micro Vickers hardness measurements carried out on the failed and in-service unfailed tube samples showed average hardness values of about 215 HV for Failed Tube No. 1, 194 HV for Failed Tube No. 2, and 176 HV for the in-service unfailed tube. No significant softening or thermal degradation was observed from the hardness measurements.

3. Tensile testing performed on specimens extracted from Failed Tube No. 1 and Failed Tube No. 2 showed that the tensile properties satisfied the minimum specified requirements for ASME SA106 Gr C material. The failed tube specimens retained ductility, and no evidence of severe embrittlement or thermal degradation was observed.

4. Optical metallographic examination of the failed and inservice unfailed tube samples revealed normal ferritic-pearlitic microstructures typical of SA106 Gr C material. The failed tube samples examined near and away from the failure regions did not show evidence of creep cavitation, grain boundary cracking, spheroidization, or significant metallurgical degradation.

5. EDS analysis of the ID side deposits revealed the presence of oxygen, silicon, aluminium, iron, calcium, phosphorus, sodium, magnesium, potassium, titanium, and manganese. The deposits were predominantly silica- and alumino-silicaterich along with iron oxide constituents.

6. Cross-sectional SEM examination of the ID side deposits showed non-uniform deposit/oxide layers. The deposit thickness ranged from approximately 47-56 um for Failed Tube No. 1 and 59-74 µm for Failed Tube No. 2.

7. XRD analysis of the ID side deposits identified the presence of Silicon Oxide(SiO2), Magnetite (Fe3O4), and alumino-silicate (mullite-like) phases. The presence of magnetite indicates water-side oxidation under boiler service conditions, whereas the silica and alumino-silicate rich phases indicate deposition of inorganic impurities during service exposure.

8. Multiple downcomer supply pipes reportedly failed in a cascade manner during service, indicating a possible systemic hydrodynamic or operational issue associated with localised turbulent flow conditions and flow redistribution within the downcomer distribution circuit.”

“11. Recommendations & Remedial Measures

1. Boiler Users may be asked to adopt a verified SelfDeclaration /Self-Certification system for periodic verification of boiler protection interlocks and other critical safety systems, in accordance with the provisions of the Boilers Act, 2025 and rules/regulations made thereunder. The audit findings shall be maintained as part of the statutory records and made available to the Inspecting Authority to support a risk-based regulatory oversight framework while promoting Ease of Doing Business (EoDB).

2. The complete Boiler Protection System (BPS), including Master Fuel Trip (MFT) logics, permissives, protection interlocks and emergency shutdown functions, shall undergo comprehensive functional validation at least once every year, after every major outage, and following any modification to the protection logic or control system. In addition, quarterly functional verification of all protection interlocks and critical safety systems shall be carried out and recorded in a secure, tamper-evident digital logbook with appropriate authentication and audit trails. The records shall be maintained for statutory inspection, third-party safety audits and regulatory review.

3. Any temporary bypass, inhibition or forcing of Boiler Protection System (BPS) interlocks, Master Fuel Trip (MFT) logic or other critical safety functions shall be permitted only under a documented authorization procedure approved by the competent operating authority. The purpose, duration and restoration of each bypass shall be recorded, continuously monitored and reviewed. All temporary overrides shall be removed immediately after completion of the intended activity, and the affected protection functions shall be functionally tested before restoration of normal boiler operation.

¶73

4. It shall be ensured that Residual Life Assessment (RLA) of critical pressure parts is carried out for all fired boilers operating at main steam temperatures of 400°C and above upon completion of 1,00,000 operating hours (as per regulation 391A(b) of IBR 1950) or maximum 15 years from the date of commissioning, whichever occurs earlier. Further, any boiler that has remained under closed & idle condition for a continuous period of three years or more shall not be recommissioned unless a comprehensive Residual Life Assessment, Non-Destructive Examination (NDE) of critical pressure parts, and a fitness certification by the Competent Person/Inspecting Authority confirm its structural integrity and safe operation.

¶74

5. Boilers taken out of service shall be placed under an approved preservation regime immediately after shutdown to prevent internal corrosion and deterioration of pressure parts. Wet preservation may be adopted for planned shutdowns up to six months, subject to continuous monitoring and maintenance of prescribed water chemistry. For shutdowns exceeding six months, or where wet preservation cannot be effectively maintained, dry preservation shall be mandatory in accordance with the OEM's preservation procedures and applicable statutory guidelines.

6. Comprehensive Standard Operating Procedures (SOPs), incorporating all critical operating parameters, safety interlocks, alarm set points and emergency operating procedures, shall be prepared, periodically reviewed and strictly implemented. In addition, the Sequence of Events (SOE) recording system shall be maintained in proper working condition to ensure accurate recording of all operational

events, alarms, trips and interlocks for effective monitoring and incident analysis.

7. Restricted Access Zones shall be established around the furnace and other high-energy pressure parts during boiler start-up, shutdown, load variations and other transient operating conditions. Access shall be limited to essential authorized personnel only, and clear emergency escape routes shall be maintained at all times.

¶80

8. A DCS-integrated audible and visual alarm system shall be provided to automatically alert operating personnel whenever critical boiler operating parameters exceed the prescribed safety limits. The system shall facilitate timely corrective action and, where necessary, prompt evacuation of personnel from hazardous areas.

¶81

9. While individual coal mills are provided with low primary air flow trip interlocks by the OEM, an additional protective interlock based on low Primary Air (PA) header pressure shall be incorporated in the Boiler Protection System, wherever not already provided. The trip setpoint shall be established in accordance with the OEM recommendations and plant operating philosophy to ensure reliable coal transportation, prevent pulverized coal accumulation and minimize the risk of combustion instability or furnace puffing.

¶82

10. The boiler control and protection system shall incorporate automatic interlocks to ensure that, following any Master Fuel Trip (MFT), mill trip or furnace trip, no fuel admission, burner light-up or coal mill operation is permitted until the furnace has been completely purged in accordance with the OEMprescribed purge requirements and approved operating procedures. The successful completion of the purge cycle shall be automatically verified by the Boiler Protection System before restoration of normal boiler operation. 11. Continuous online oxygen (Os) and carbon monoxide (CO) analyzers shall be provided for real-time monitoring of furnace combustion conditions and integrated with the Distributed Control System (DCS). The system shall generate timely alarms for abnormal combustion conditions and assist operators in taking prompt corrective action. Wherever technically justified and approved by the OEM, the analyzer outputs may be utilized as supplementary inputs to the Boiler

Protection System for initiating appropriate protective actions to minimize the risk of furnace puffing.

12. The reliability of safety-critical instrumentation associated with the Boiler Protection System (BPS) shall be enhanced by providing appropriate redundancy, fault detection and validated voting logic for critical protection parameters, wherever justified by design and risk assessment. The selection of redundant transmitter configurations, including two-out-of-three (2003) voting where applicable, shall be based on the OEM recommendations, applicable standards and plant-specific protection philosophy to minimize spurious trips while ensuring dependable operation of boiler protection systems.

¶87

13. The furnace buckstays, casing supports and other structural members affected by the accident shall be repaired or replaced in accordance with the OEM design specifications and approved engineering standards. The restored structure shall be subjected to a detailed structural integrity assessment, including alignment checks and load-bearing verification, before recommissioning. Wherever considered necessary by the OEM, suitable design improvements may be incorporated to enhance the structural resilience of the furnace against abnormal pressure excursions.

¶88

14. The complete support arrangement of downcomers, headers, water wall link pipes and associated pressure parts shall be reviewed by the OEM through a detailed structural and piping stress analysis. Based on the findings, suitable support modifications, including the provision of additional guides, restraints, hangers or other support systems, wherever necessary, shall be implemented to accommodate thermal expansion, reduce mechanical stresses and ensure the longterm structural integrity and safe operation of the boiler

15. All IBR-certified Boiler Operation Engineers (BOEs) and operating personnel shall undergo periodic refresher training and competency assessment, including simulator-based training wherever available, with emphasis on transient operating conditions, combustion instability, emergency response, safe shutdown procedures, Master Fuel Trip (MFT) conditions and adherence to Standard Operating Procedures (SOPs). The effectiveness of such training shall be periodically reviewed and documented by the operating organization.

16. The Distributed Control System (DCS) shall be equipped with an effective First-Out (FO) alarm management system for all critical boiler protection and trip conditions. The system shall identify and display the initiating cause of the trip, prioritize critical alarms and minimize alarm flooding during abnormal operating conditions to facilitate timely operator response and safe restoration of the unit.

¶93

17. The Inquiry Committee emphasizes corrective and preventive measures aimed at strengthening boiler safety through enhanced operational practices, improved safety interlocks, periodic structural integrity assessments and implementation of an effective self-certification and compliance framework. Based on the evidence examined during the inquiry, the Committee observed that the accident resulted from a high-speed thermal-hydraulic transient and associated operational factors rather than any deliberate or wilful act. Accordingly, the Committee does not find sufficient grounds for recommending penal action under the provisions of the Boilers Act, 2025.

18. Possession of a Boiler Operation Engineer (BOE) Certificate alone shall not qualify an individual for independent operation of high-pressure, subcritical or supercritical boilers. Before assuming independent charge, the BOE shall successfully complete plant-specific practical training, operating experience, emergency handling exercises and competency assessment. The operating organization shall maintain documented records of such training and authorize independent operation only after satisfactory evaluation of the engineer's competence.

¶95

19. The affected boiler pressure parts, structural components, along with all associated mountings and fittings, shall be offered for a comprehensive internal and external statutory inspection by the Competent Person. Any subsequent structural remediation, pressure part repairs, or modifications recommended during the inspection shall be executed strictly under the guidance, supervision, and final approval of the Chief Inspector of Boilers, Chhattisgarh, in compliance with the Indian Boiler Regulations (IBR).”

Internal Trade (DPIIT), Ministry of Commerce & Industry, Govt. of India, thus, Respondent/Project Proponent is directed to comply the recommendations of the Committee. It is further reported that the amount of compensation to the deceased has been paid to the tune of Rs.35 lakhs each to the deceased and Rs.15 lakhs each to the injured, thus, the affected persons have been properly compensated by the Unit.

The matter has been taken on suo moto basis. The remedial measures have already been taken and the injured/affected persons have been compensated. Thus, no further action is required. However, we accept the report of the Committee mentioned above and direct the Respondent/Project Proponent to strictly monitor and to ensure to avoid any further incidents in future.

With these observations, the Original Application No.99/2026(CZ) along with pending I.As., if any, stands disposed of .
