By this appeal filed under Section 16 and 18 of the National Green Tribunal Act, 2010, appellant has challenged the order dated 17.12.2025 passed by the PPCB, imposing the environmental damage compensation. There is a delay of 31 days in filing this appeal. Hence, IA No. 198/2026 has been filed by the appellant seeking condonation of delay.

Learned counsel for the appellant submits that the impugned order dated 17.12.2025 was received by the appellant on 20.12.2025. Thereafter, on account of the wrong legal advice, the appellant had filed the representation before the Principal Secretary, Department of Environment, Chandigarh, on 12.01.2026. The said representation was dismissed on 02.02.2026 as not maintainable. Thereafter, the appellant had taken steps for filing the present appeal before the Tribunal, which has been filed on 16.02.2026. A further explanation has been furnished by the appellant in the application for condonation of delay that the appellant is a small-scale industrial unit and does not have an inhouse legal or technical department

for rendering the correct advice. Therefore, the time was consumed in taking steps for filing the appeal.

The explanation furnished in the application for condonation of delay reveals that the appellant was prevented from filing the appeal within time on account of the bona fide reason. The delay in filing the appeal is unintentional. Even otherwise the appellant is entitled to the benefit of exclusion of the period for which he was prosecuting the matter before the wrong authority. In the aforesaid circumstances, we are of the view that a case for allowing the prayer for condonation of delay is made out. Accordingly, IA No. 198/2026 is allowed and the delay in filing the appeal is condoned.

Learned counsel for the respondent-Punjab Pollution Control Board seeks six weeks’ time to file the reply on merit.

Rejoinder, if any, can be filed by the appellant within eight weeks.
