Tribunal by order dated 05.01.2026 had imposed the cost of Rs. 1 lakh as, inspite of service of notice no one had appeared on behalf of respondent no.2-MoUD.

I.A. No. 191/2026 has been filed by respondent no.2 seeking waiver of cost.

The Learned Counsel for respondent no.2 has argued that notice of OA was sent to incorrect department of the respondent no.2, but on perusal of para 4 of the I.A., we find that respondent no.2 itself has admitted that notice was received by Central Registry Section of the Ministry on 21.10.2025 but due to inadvertent administrative error, it was wrongly marked to another division. Hence, we find that argument advanced in support of the I.A. is contrary to the plea taken in the I.A. Thus, the error was not on the part of the Registry of the Tribunal or the applicant but it was on the part of respondent no.2. Hence, we do not find

it to be a good case for waiving the cost. However, considering the circumstances, we reduce the cost from Rs. 1 lakh to Rs. 10,000/- which is to be deposited within two weeks. I.A. No.191/2026 is accordingly disposed of.

A letter has been circulated by Counsel for respondent nos. 3 to 5 seeking adjournment for filing the response within two weeks. Prayer is allowed.

Rejoinder, if any, can be filed by the applicant within eight weeks.
