In this original application, the Applicant has raised a complaint against encroachment on a Johad (Pond) situated in Village Savitri Nagar (earlier known as Village Sheikh Sarai, New Delhi 110017). The plea of the Applicant is that the pond is admeasuring 4 bighas and on that pond illegal construction of a temple has been made. The Applicant alleges that the pond has been encroached. Learned Counsel for the Applicant in support of the said plea has referred to the photographs filed as Annexure R-4, but these photographs do not have any geo-coordinates or date. Therefore, it cannot be ascertained from these photographs, if the construction has been raised on the pond or it has been encroached upon.

Learned Counsel for the Applicant has also submitted that the complaint Annexure A-1 dated 24.09.2024 was made by the Applicant to the District Magistrate (South), Malviya Nagar, but no action on the said complaint has been taken.

The record reflects that the complaint was made to the Delhi Pollution Control Committee (DPCC) also and the DPCC vide communication dated 11.03.2025 has forwarded the complaint to the District Magistrate, South and the Commissioner, MCD directing the Revenue Department and the MCD to take action against encroachment and illegal construction on the pond.

Thus, the said communication reveals that the matter is now pending before the District Magistrate, South and the Commissioner, MCD. These authorities are required to expeditiously ascertain the status of the pond in question by carrying out spot inspection and, if any encroachment is found on the land of the pond, take appropriate remedial and punitive action. They are expected to complete this exercise within a period of three months from the date of receipt of a copy of this order.
