This MA has been registered based on the report dated 30.04.2024 filed by Respondent No. 4, M/s. Northern Coalfields Ltd., Kakri Project, in compliance with the order of the Tribunal dated 05.01.2024 passed in OA No. 611/2022.

In OA No. 611/2022, Applicant had raised the grievance that Village Rehta was a rehabilitated village under NCL, Kakri Project in Sonebhadra. The complaint was that 8 RO plants were installed there under CSR. Out of them only three were operating and five RO plants were closed and the residents were deprived of drinking water and the Community Centre constructed under CSR about 34 years ago was in a dilapidated condition. The Tribunal while passing the order dated 05.01.2024, had recorded the statement of Counsel for Respondent No. 4 that the work of Har Ghar Jal Yojna was 80% complete and was likely to

be 100% complete within two months. Hence, by order dated 05.01.2024,

the OA was disposed of by directing as under:

“xxx ………………………………..xxx…………………………………..xxx 3. Learned Counsel for the Respondent no. 4 has informed that the work of Har Ghar Jal Yojna is 80 % complete and likelyto be 100 % complete within two months.

4. The above development reflects that the grievance raised in the present letter petition has been substantially be redressed. Hence, we disposed of the present original application with the direction to Respondent no. 4 to file further report indicating the progress in the matter of pipeline arrangement under Har Ghar Jal Yojna in the two villages by 30.04.2024 by e-mail at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF before the Registrar General of the Tribunal and if found necessary, matter will be listed before the Bench for consideration.”

In compliance of the above direction, Respondent No. 4 has filed the report dated 30.04.2024 based on which the present MA has been registered.

The report filed by Respondent No. 4 reveals that the water supply through the pipeline arrangement of Har Ghar Jal Yojna is being done to 90% of the households. Learned Counsel for Respondent No. 4 has informed that now 100% household of that area are covered under Har Ghar Jal Yojna. The reply further states that clean drinking water is supplied through 11 RO plants. Counsel for Respondent No. 4 has informed that all 11 RO plants are functional. The compliance report by Respondent No. 4 states as under:

“xxx …………………………………xxx…………………………………xxx 2. The laying of pipeline arrangement and other related works (Interconnection to the treated tank of 11 nos, RO plants etc.) of "Har Ghar Jal Yojna" under Jal Jeevan Mission, covering both the villages of Rehta and Bansi, for supply of clean drinking water to the inhabitants of both the villages, has been completed. A copy of letter dated 27.04.2024 issued by U.P Jal Nigam (Rural), Sonebhadra is annexed herewith as ANNEXURE R-4/1 .

3. Furthermore, the water supply through pipeline arrangement of "Har Ghar yojana" is being done to 90% of the households and

prompt rectifications works are being carried out by the executing agency which has submitted that within one week, water supply from "Har Ghar Jal Yojana" to each and every household of both the villages of Rehta and Basi would be extended.

A copy of letter dated 27.04.2024 issued by L&T is annexed herewith as ANNEXURE R-4/2 .

4. The Kakri Project of Northern Coalfields Ltd. has been taking every step to ensure the continuation of clean drinking water supply through all 11 Nos. RO plants installed at various points in both the villages of Rehta and Basi, by means of rigorous monitoring system to the satisfaction of the inhabitants. Photographs of RO plants is annexed herewith as ANNEXURE R-4/3 .

That in addition to above arrangements of supplying clean drinking water to the inhabitants of both the villages of Rehta and Basi i.e., by pipeline connection to each and every household under "Har Ghar Jal Yojana" and 11 Nos. RO plants, there is an alternate provision to supply clean drinking water by means of water tankers, to address cases of emergency/ complaint by any inhabitant. Photographs of Water Tanker is annexed herewith as ANNEXURE R- 4/4 .

6. That Kakri Project of Northern Coalfields Ltd. is performing such welfare function towards society which is necessary in maintaining the social interest of the society.

7. That Kakri project of Northern Coalfields Ltd has been taking every step to ensure continuation of clean water supply through RO plaints to the inhabitants of village Rehta and Bansi by means of rigorous monitoring of system existing in place. Northern Coalfields Ltd is performing such welfare function towards society, which is necessary for maintaining the social interest of the society.”

In view of the above, no further report in the MA is required at this stage, which is accordingly disposed of directing Respondent No. 4 to ensure continuous uninterrupted supply of the water/drinking water in the Rehta and Bansi villages which are under consideration in this matter.
