The Original Application No.01/2023/EZ was filed by the Applicants therein alleging that there is a residential society known as ‘Manorama Estate Welfare Society’ built in 1996 at Bomikhal, comprising about 250 families most of whom are said to be senior citizens. It is stated that land next to this society is a pond commonly known as ‘Sabarsahi Pond’ which acts as an aquifer for the waste discharge from the society and other residential units of the society. It is stated that this Plot is marked as ‘Adi Jalasaya’ (ancient water body), covered under Plot Nos. 401, 402, 403, 405, 369, 370, 371 and part of Plot No. 184, bounded from three sides for access through Plot Nos. 372, 375, 376, 378, 379, 399, 400, 406, 408 and 411, which are owned by the General Administration Department, Government of Odisha. The Applicant No.1 is stated to be residing at Plot No. 373 and accesses the pond through Plot No. 372 (western boundary wall of the house of Applicant No.1).

It is alleged that the Respondent No.8, M/s Shuvam Construction Private Limited, has started making construction by filling-up the said pond with debri thereby completely disturbing it and damaging the garden created around the pond. It is also stated that the Respondent No.8 has been granted Environmental Clearance by the SEIAA, Odisha, (Respondent No.6), as informed to the Applicant from the minutes of the 130th Meeting of SEIAA, Odisha, held on 24.06.2015.

It is also alleged that the said Environmental Clearance was granted for five years and from 07.12.2022 the Respondent No.8 had started construction of permanent structures over the foundation of the outer boundary wall of Manorama Estate Welfare Society and depositing the debri in the Sabarsahi Pond leaving no free space between the constructions for rainwater or drains.

The said Original Application was disposed of by this Tribunal vide order dated 14.03.2023 with the following directions:-

“24. In view of the categorical averments made, we direct the State Respondents to carry out a survey of the entire land and demarcate the area occupied by the construction company, Government land over which Netaji Nagar Basti is existing, and existence of Adi Jalasaya with a concrete pillar structures etc. 25. The General Administration and Public Grievances Department/State Respondents shall also take steps for restoration of Plot Nos. 402 and 370 recorded as „Jalasaya Dui‟ (Pond) in the revenue records and create a green belt around the area under the supervision of the local urban body during the coming monsoon season. This will not only help in recharge of ground water but also provide a cool and healthy atmosphere to the surrounding area.

26. We also issue a direction to the Bhubaneswar Municipal Corporation/Bhubaneswar Development Authority to prepare an Action Plan for clear passage of waste water and rain water from the Manorama Estate Welfare Society and nearby colonies so that 15 adequate flow of drain water is taken care of and there is no overflow of drain water/rain water or submergence of the colonies in question during the monsoon season.

27. The State Pollution Control Board, Odisha, shall also take steps to ensure that the colonies in question establish adequate Effluent Treatment Plant (ETP)/Sewerage Treatment Plant (STP), as the case may be, to ensure that raw sewage is not allowed to flow into the common drain and from there to canal.

28. Let an Action Taken Report be filed by the Collector & District Magistrate, Khurdha, as well as the State Pollution Control Board, Odisha, by 31.07.2023 with the Registrar, National Green Tribunal, Eastern Zone Bench, Kolkata, on affidavit.

29. With the aforesaid directions, the Original Application No.

01/2023/EZ is accordingly disposed of.”

When no Action Taken Report was filed in respect of the directions given by this Tribunal in its order dated 14.03.2023, Miscellaneous Application No.20/2023/EZ was registered and notices were issued to the concerned Respondents.

The Respondent No.7, State Pollution Control Board, Odisha has filed affidavit dated 31.07.2023 stating that the Pollution Control Board had carried out inspection on 17.07.2023 and it was found that no steps had been taken by the Manorama Estates Welfare Society for compliance of the directions of the National Green Tribunal regarding providing of treatment system like ETP/STP.

It is stated that thereafter directions were issued by the Regional Officer, Bhubaneswar directing the Secretary of Manorama Estates Welfare Society to take immediate steps for compliance of the direction of the National Green Tribunal.

Thereafter, an inspection of the site was carried out on 17.07.2023 by the State Pollution Control Board. The Inspection Report reads as under:-

A. Basis of inspection:-

Site inspection was conducted on dtd. 17.07.2023 w.r.t. to the letter received from the Member Secretary, vide NO.4348, dtd.22,03.2023& No.9597 dtd.16.06.2023 and Letter No. 5600 dtd. 04.04.2023 on the above cited case matter as per the direction at Para-27 of Hon'ble NGT vide their order dtd. 14.03.2023 in OANo. 01/2023/EZ - Bibhu Das & Anr. Vs. Bhubaneswar Municipal Corporation & Ors..

Order of the Hon'ble NGT in Para-27 regarding presence of ETP/STP i.e. Operating within the premises of the colonies of M/s. Manorama Estate relates to case matter and the disposal practices of the domestic raw sewage.

B. Information about site inspection:-

As per the direction of the Hon'ble NGT and letter received from member Secretary an inspection was conducted Into M/s. Monorama Estate Welfare Society Colony area which is existing nearby the area on which the case was filed by Dr. Bibhu Dash & Others on dtd.17.07.2023 by the undersigned officials of Regional Officer, SPCB, Odisha, BBSR.

During the time of inspection the Secretary of the said society Sri Pravakar Panda was present and had accompanied to go around the various drainage system, those are existing within colony campus, their flow system along with surrounding outside area and the concreted new drainage system that is running at the backside of the said Estate along the boundary wall to facilitate the flow of rainwater and domestic waste water.

C. Observation During site inspection:-

a. Large numbers of dwelling houses/buildings are existing within the premises of M/s Monorama Estate Welfare Society.

¶82

b. Under the banner of M/s Monorama Welfare Society various types of building structures are existing i.e. Manorama Duplex, Manorama Simplex, Manorama Mansion, Manorama Enclave, Manorama Tower comprising about 250 family (As has been cited in the case matter) and as per the statement of Secretary of the Estate Sri Panda around 600 persons are residing since long back within the colony.

c. While going round within different housing area within the colony it was observed that all existing building structure are provided with concreted drainage system covered with concreted slab and finally have their channel to main concreted drains have got their passage to outside the premises in an on organized manner with barren busy land. Also it was observed that nearby to the undersigned flow system domestic waste water large number of dwellers have concreted drainage system.

d. Also it was observed that nearby to the unorganized flow system of domestic waste water number of dwellers have constructed their building with their concreted drainage system.

¶85

e. During the site inspection it was ascertained that the number houses/building which are existing those have has been developed in the due course time i.e. much after the development period of M/s. Monorama Estate so far which since that period the domestic waste water are being discharge through the unorganized barren land leading upon an near by flow system Gangua Drain which carries the waste water from various U/S sources.

f. After large scale raising of houses/building nearby to the Monorama Estate the disposal practices of waste water from the said colony has been/being

gradually squeezed and not getting clear passage for easy flow of domestic waste water which leading up to gangue drain.

¶89

g. No concreted drainage system with adequate length and width is existing to carry the domestic water of colony outside the colony premises leading up to Gangua drain.

¶90

h. As per the information received from the Secretary of the said Estate that the toilet fecal material etc. waste water are being discharge to soak pits with drainage system without being mixed with drains carrying the waste water from bathroom, Kitchen, Washbasins etc. those are being discharge to outside premises

¶91

i. Also another waste water carrying concreted drain which is passing at the backside of the colony area i.e.all along the Estate„s backside premises wall which has no such facilities to allow for clear passage of carrying domestic waste water from the outlet part of all the drains excepting the facility for passage of rain water(As reported by the Secretary of said Estate) .

j. No treatment system like ETP/STP of adequate size and capacity has been developed by M/s Manorama Estate for treatment of domestic waste water before land discharge/to any drainage system. So untreated domestic sewage are being discharged to nearby unorganized barren-bushy & swampy land that is finally leading to Gangua drain.

¶93

 Remark:-

¶94

a) The Monorama Estate Welfare Society should develop a ETP/STP system of adequate capacity within a specific time period so as to treat all the domestic waste water of the colony before its discharge to nearby land with meeting the prescribed standard w.r.t. Parameters like-pH, TSS, BOD & Coliform Bacteria without further delay/fail.

b) Bhubaneswar Municipality Corporation/Authority should take Immediate steps to provide a adequate

depth, length as well width of concreted drainage system to facilitate clear/easy/Passage of treated of waste water leading up to Gangua drain so as to overcome the un-hygienic waste water problem along with water logging within Monorama Estate during heavy rainfall”.

Thereafter, a further affidavit has been filed by the State Pollution Control Board dated 05.10.2023 bringing on record another Inspection Report of an inspection carried out on 15.09.2023 which reads as under:-

“FACT FINDING REPORT ON HON’BLE NGT MISC. APPLICATION NO. 20/2023/EZ IN OA NO. 01/2023/EZ WITH RESPECT TO CASE FILED BY DR. BIBHU DASH & ANR. VRS BMC & OTHERS

BACKGROUND OF THE INSPECTION:-

¶101

 Details about the direction of the Hon’ble Tribunal: As per the order dtd. 14.03.2023 of the Hon'ble NGT, EZB, Kolkata in OA No. 01/2023/EZ in the matter of Dr. Bibhu Dash & Anr. Vs. Bhubaneswar Municipal Corporation & Ors. in para -27 the State PCB s to take steps to ensure that the colonies in question to establish adequate capacity of ETP/STP and the estate has been directed not to discharge its domestic raw sewage into common drainage system without treatment.

Basis of Inspection to the premises of estate to

¶103

verify the ETP/STP status:

¶104

As per the order of the Member Secretary, State Pollution Control Board, Odisha vide No.13724, dtd:29.08.2023 and Letter of Collector and District Magistrate Khurda vide No.11843, dtd:31/08/2023.

Information regarding provision of ETP/STP of

¶106

adequate capacity for treatment of domestic raw sewage of the colony in question of M/s. Manorama Estate:

¶107

As per the above cited direction of the Hon'ble Tribunal, an inspection to the colony area in question was conducted by the SPCB Officials on 15.09.2023. During the day of inspection to the housing project, the President of M/s. Manorama Estate Welfare Society associated for housing project visit and subsequently a meeting was held and

discussed regarding the wastewater management system adopted and operational status by the said welfare society.

¶110

On the day of visit the following information was provided by the President of the welfare Society of said estate: -

¶111

a) Total 7 types of Residential buildings complex are present within the colony area where approx. 750 to 800 per people are residing and as reported total consumption of water is 170-180 KLD.

¶112

b) As stated by the President of welfare association, that all the residential flats had been constructed construction during the year 1994-2005 in phase wise manner and the drainage system of all the flats are connected to septic tank followed by soak pits of each apartment along the colony area.

¶113

c) As reported on 15-09-23 and 16-09-23 communicated through letter to Regional Officer, Bhubaneswar it was informed that all the septic tank and soak pits are of capacity 730KL and 600KL respectively.

¶114

d) The sewage water those are being generated from households are mostly channelized into septic tank and soak pits and no raw sewage and sullage are being discharged to outside premises. Also, the fecal material of septic tank are usually cleared through sewage disposal tanker.

¶115

e) As it was ascertained from the President of the Society that all the residential complex have been developed relatively low lying area and those has been spread over large patch of land and have been developed in phase wise manner.

¶116

f) The gradient system of the entire area is not uniform for which the entire drainage pattern has not been uniformly connected with each other.

¶117

g) The maximum portion of the drainage system within the society has been spread underground for which the contour and flow pattern of wastewater couldn't be ascertained. During heavy rainfall the storm water along with surface runoff from nearby areas are directly entering into colony area due its contour and finally resulting water logging at various locations within colony areas. This water logging sometimes gels contaminated with other wastewater generated from households resulting in unhygienic conditions. There is no escape route for release of those wastewater as there in no municipal drainage system existing outside the boundary area.

OBSERVATIONS DURING INSPECTION: -

a) During inspection the same situation/status is prevailing which was noticed during earlier inspection on dtd 17-07-2023 that the said estate

welfare association has not yet set up/start any construction cum installation work of ETP/STP for treatment of domestic wastewater which are being generated from different sources of colony areas.

¶122

b) During both the day of inspection to the site i.e. on 17-07-2023 During both the day of inspection to the site i.e on 17-07-2023 and 15-08-2023 it was ascertained from both the Secretary and President that as the internally existed concreted drainage pattern all over the project area has not been designed in such manner since its earlier phase of construction work, hence it is not feasible to set up STP facilities within the premises.

REMARKS :-

¶124

a) The housing complex as of now has not installed STP for treatment of sewage water generated from different households‟ complexes.

¶125

b) During heavy rain fall the rainwater from upland nearby areas/roads is entering into the

¶126

estate premises causing water logging at different areas within the premises. These storm water might be getting contaminated after coming in contact with the open drains existed within the campus.

¶127

RECOMMENDATION/VIEWS:

¶128

To avoid this condition following steps may be taken/ initiated without further delay:-

¶129

a) The authority of WATCO Department, Govt. of Qdisha (Unnati Bhawan, Satya Nagar, BBSR) may be directed to depute their expert Engineers for detail survey of the area in question and may be asked to submit a work plan/DPR to Hon'ble Tribunal regarding possibility for set-up adequate capacity STP system within specific time limit inside the colony area for treatment of Domestic waste water as and when required before discharge to outside the premises after meeting the prescribed standard of the Board.

b) Let the expert Committee of concerned Department may suggest to eradicate water logging condition within premises during rainfall for ever and whether there can any feasible possibility to treat the waste water of colony area before discharge to outside premises.

¶131

c) Also the Bhubaneswar Municipality Authority may be directed to provide drainage system facility outside the premises of the colony area in question which can be connected to nearby Municipal drainage network”.

¶133

The Inspection Report of the inspection carried out on 17.07.2023 has interalia noted that all the existing building structures are provided with concreted drainage system covered with concreted slabs having passage to outside the premises in an unorganized manner; there was unorganized flow of domestic waste water and water was being discharged through unorganized barren land leading to nearby flow system of Gangua Drain.

This report also noted that toilet faecal matter etc. and waste water are being discharged to soak pits with drainage system without being mixed with drains carrying the waste water from bathroom, kitchen, washbasins etc. and those are being discharged outside the premises; no treatment system like ETP/STP of adequate size and capacity has been provided and untreated domestic sewage is being discharged to nearby unorganized barren-bushy & swampy land which finally drains into the Gangua Drain.

Accordingly, the Committee gave certain directions that the Manorama Estate Welfare Society should develop ETP/STP system of adequate capacity within a specific period of time and take immediate steps to provide adequate depth, length as well as width of concrete drainage system to facilitate clear/easy/passage of treated waste water leading up to Gangua drain.

¶136

The Inspection Report of another inspection carried out on 15.09.2023 has noted that in the said Society, there are 7 Residential buildings and approx. 750 to 800 people are residing and total consumption of water is 170-180 KLD; the drainage system of all the flats are connected to a septic tank followed by soak pits of each apartment in the colony area; each septic tank and soak pits are of capacity 730KL and 600 KL respectively; no

raw sewage and sullage is being discharged outside the premises; faecal material of septic tank are cleared through sewage disposal tanker.

¶139

The Committee also noted that the residential complex has been developed in a low lying area and the gradient system of the entire area is not uniform and the drainage pattern has not been uniformly connected with each other. The Committee also noted that during heavy rainfall, the storm water along with surface runoff from nearby areas directly enters into the colony area due to its contour and gradient resulting in water logging at various locations within the colony; this water logging also sometimes gets contaminated with other wastewater generated from households resulting in unhygienic conditions; there is no escape route for release of waste water as there is no municipal drainage system existing outside the boundary area of the residential complex. The Committee also noted that the housing complex has not installed STP for treatment of sewage and sullage water generated from different households’ complexes since the concrete drainage pattern in the project area has not been designed in such a manner to facilitate setting up of STP within the premises.

The Bhubaneswar Municipal Corporation in its affidavit dated 22.09.2023 has stated that it surveyed the entire area during joint demarcation process and found that the Manorama Estate Welfare Society is an old housing society constructed before the year 2000 having no drainage facility of its own; at that time the society used to discharge the entire drain water/rain water and its untreated sewage to the adjacent vacant plots; the Manorama Estate lies comparatively at a lower level than that of the main drain passing

by the side of the Cuttack road and therefore it is not possible to drain the rain water of the Estate to the main drain even if the gated society now constructs its internal drain.

The Bhubaneswar Municipal Corporation therefore suggested that the only option available before the Corporation is to drain the storm water/rain water into the main drain by pumping it, provided the Society constructs its own internal drain and brings it to a chamber near the main drain constructed by the Works Department of the Government of Odisha.

It was also suggested that the Housing Project may be directed to have its own rooftop rain water structure which will in turn recharge the Ground water and the surplus rain water can easily be pumped into the main drain. Suggestion was also made that the Developer may be directed to have its own sewerage treatment plant as per the established norms.

The State Pollution Control Board, Odisha has filed further affidavit dated 18.10.2023 stating that the Water Corporation of Odisha (‘WATCO’, for short) has intimated that they have visited the site of M/s Manorama Estate Welfare Society and has reported that no sewerage system is available in the vicinity of the Society and it is not feasible to connect the sewage outflow of M/s Manorama Estates to their system through gravity as the premises is situated in a low lying area and that WATCO has suggested that a pumping station be constructed in the premises of the Manorama Estates and sewage be pumped to the nearby sewerage system at the Durga Mandap, Bomikhal, Bhubaneswar.

The WATCO has filed its affidavit dated 14.03.2024 to the same effect as already mentioned in the affidavit of the Odisha State Pollution Control Board.

¶151

The Respondent No.1, Manorama Estate Welfare Society has filed affidavit pointing out that it has already been noted in the Inspection Report that the septic tanks and soak pits have been constructed within the established area and there is no raw sewage discharged outside the colony. It is acknowledged that there is a practical difficulty to have one centralized Sewage Treatment Plant (STP) within the Residential Area as the residential units are scattered and the land is located on varied elevations but nevertheless, each unit has its own Septic Pit and Soak Pit to treat waste water.

The Society also sought a direction to the Bhubaneswar Municipal Corporation (BMC) to provide a connection to the Drain passing near Lane 2 of Nigamanand Nagar Colony which is at a lower elevation than the society so that water can flow down along the natural gradient without requiring any Pumping station. It is stated that Centralized Sewage Treatment Plant is not feasible since the Society has its units located in varied contours without having any uniform gradient and therefore septic tanks within the Society are periodically cleared using the Tanker which disposes off the same in the nearest Sewage Treatment Plant operated by Water Corporation of Odisha (‘WATCO’, for short).

The Bhubaneswar Municipal Corporation (BMC) has filed further affidavit dated 12.01.2025 stating that in pursuance of the order of the Tribunal dated 20.11.2024 the Executive Engineer, Drainage Division of Bhubaneswar Municipal Corporation enquired into the

matter and after physical verification of the area in question submitted its report which is as follows:-

i. That, a team of experts and professors from IIT Roorkee is on boarded by Bhubaneswar Municipal Corporation for detail study on comprehensive storm water Management plan to address major waterlogging issues within the urban local body.

¶157

ii. That these divisions under Bhubaneswar Municipal Corporation shall study the contour of entire catchment involving Manorama Estate and make a holistice plan for drainage issues.

iii. That similarly concerned department, i.e. WATCO shall be intimated for their sewerage plan.

iv. That the scope of drainage works for Manorama Estate shall be decided after study and evaluation of records and produce of additional information required (Number of. Households, Daily water consumption, Approvals of Bhubaneswar Development Authority (BDA) like occupancy certificate, Drainage clearance and details of existing RHS and underground tanks) for the society. The project will be start soon after receiving the detailed report from the concerned departments.

v. That, again the Sewage issues of the Manorama Society to be addressed in consolation with Water Corporation of Odisha (WATCO) Sewerage for pumping station/alternative methodology for efficient disposal of household grey and black water”.

This report mentions that a team of experts and professors from

IIT, Roorkee have been taken on board by the Bhubaneswar Municipal Corporation for carrying out a detailed study on the

comprehensive storm water Management plan to address major water-logging issues within the urban local body.

We have heard the learned Counsel for the parties and examined the documents on record.

It is not disputed that the Manorama Estate Welfare Society has several residential housing units which are situated at different locations having different land gradient and contours which is the cause for non-drainage of the domestic sewage and waste water into the municipal drainage system and also for construction of STP within the Manorama Estate Complex.

However, considering that the Bhubaneswar Municipal Corporation has requested the researchers of the IIT Roorkee to survey the area

and submit its report particularly with regard to the issues of gradient and flow of sewage of the Manorama Estate, we dispose of this Miscellaneous Application with a direction to the Bhubaneswar Municipal Corporation to complete the entire process of preparing the report and the financial `` implications involved therein within a period of three months and thereafter proceed to execute the report of the expert team of IIT Roorkee within a given timeline of one year.

The Miscellaneous Application No.20/2023/EZ is accordingly disposed of.

I.As., if any, stand disposed of accordingly.
