In both the connected Appeals, the Environmental Clearance (EC) dated 13.01.2025 issued in favour of the Respondent No. 5 – M/s RR Texknit LLP is under challenge.

IA No. 738/2025 in Appeal No. 15/2025 has been filed by Respondent No. 5 and IA No. 739/2025 in Appeal No. 19/2025 has been filed by the Respondent No. 3 for summary dismissal of the appeal.

Submission of learned Senior Counsel for the Respondent No. 5 is that as many as eight unsuccessful attempts have been made by the Appellant before the Delhi High Court, NGT and Hon’ble Supreme Court and that the issue now stands concluded by the order of the Hon’ble Supreme Court dated 12.08.2025 passed in IA No. 126582/2025 and connected IA’s. The orders which are passed by the different courts including the Hon’ble Supreme Court have been placed on record with the IA.

We are of the view that since it’s a statutory appeal against the EC, therefore, the orders which have been placed on record alonwith IA Nos. 738/2025 and 739/2025 can be considered at the time of hearing of the Appeal.

Learned Senior Counsel appearing for the Respondent No. 5 also submits that let this application be treated as an application for placing the additional material on record.

IA No. 738/2025 and IA No. 739/2025 are treated to be applications for placing the additional documents on record and are allowed.

It will be open to the Appellants to file additional material in response

to the documents placed on record with the above IA’s.
