By this Execution Application (E.A.), applicant is seeking compliance of the order dated 30.10.2017 passed in OA No. 551/2017. In the Original Application (OA), the applicant had raised a grievance against dumping of the solid waste near the school and the OA was disposed of by recording the statement of counsel for the SDMC by the following order:-

“ The Learned Counsel appearing for SDMC submits that they will examine the complaint made in relation to dumping of waste near the school and take appropriate steps expeditiously and in any case not later than 4 weeks from today. It is further stated that she will ensure that no waste is dumped adjacent to the wall of the school and whatever waste is dropped, the same will be managed and disposed of in accordance with the Solid Waste Management Rules, 2016.

We dispose of this Application with a direction to the Corporation to take appropriate steps in accordance with law.

Thus, Original Application 551 of 2017 stands disposed of without any order as to cost.

This application does not survive for consideration as the main application itself stands disposed of.

The applicant had approached the Tribunal after almost eight years of passing of the aforesaid order. Management of the solid waste at a particular place may give a recurring cause of action. This indicates that probably the applicant did not have any grievance earlier and on accrual of fresh cause of action he has approached the Tribunal again. Be that as it may, since the applicant alleges that the solid waste is accumulated and not properly managed in the area concerned, we dispose of the E.A. directing the respondent authorities to take due action expeditiously to clear the same having regard to the order already passed by the Tribunal.
