Mr. Deepak Rana resident of Parashuram Colony, Sohna Road, HUDA Sector-2, Palwal, Haryana had sent to this Tribunal a letter petition, which was treated and registered as O.A. No. 696/2024.

The applicant raised the grievances that Municipal Corporation, Palwal was dumping garbage in drains passing adjacent to National Highway leading to Gurugram to Delhi and Faridabad causing blockage and water logging and thereby causing damage to environment.

This Tribunal disposed of the O.A by constituting a Joint Committee comprising Deputy Commissioner, Palwal and Haryana State Pollution Control Board and directing the same to visit the site, collect relevant information and if it found any violation of environmental laws and norms, to take appropriate preventive, prohibitive, punitive and remedial action against the violators in accordance with law and submit a compliance Report with Ld. Registrar General of this Tribunal within two months who was given liberty to place the matter before the Bench for further orders, if so considered necessary.

In compliance thereof, report dated 19.03.2025 was filed by the Joint Committee. The relevant part of the report reads as under:-

“2. In compliance of Hon'ble NGT directions, a letter dated 27/08/2024 was sent by the Regional office, Palwal to the Deputy Commissioner, Palwal to depute the concerned officer/nominee within 07 Days for conducting the inspection so that factual and Action Taken Report may be submitted before Hon'ble National Green Tribunal, New Delhi well within time (Annexure RI1). The Deputy Commissioner, Palwal deputed concerned area Sub-District Magistrate as his nominee for the joint inspection vide letter dated 23/10/2024 (Annexure R/2).

3. On January 31, 2025, the joint committee, accompanied by the complainant and officials from the Municipal Corporation (MC) of Palwal, inspected the site. The MC, Palwal, undertook the following measures: Cleaning the site, removing all solid waste, learing the drain, installing lights, erecting boundary fencing, and placing warning and information boards to prevent future waste dumping. Additionally, an employee has been assigned by MC, Palwal, to monitor the site and enforce fines for violations. The complainant expressed satisfaction with these actions, and a signed inspection report has been obtained to confirm this (Annexure RI3). Photos of the joint committee visit are attached as Annexure R/4.

On 03 February 2025, the concerned field officer conducted a follow-up visit of the site to verify the actions initiated by the Municipal Corporation of Palwal regarding the regular maintenance of cleanliness and site found clean and in compliance. Photos of the follow up visit are attached as Annexure R/5.”

Considering further orders to be necessary, the matter was listed

before this Bench by registering the report as M.A. No. 44/2025.

Vide order dated 16.04.2025 this Tribunal sought response from (1) State of Haryana through District Magistrate, Palwal; (2) Municipal Corporation, Palwal through its Commissioner; and (3) HSPCB through Member Secretary who were impleaded as Respondents No. 1 to 3.

In compliance thereto, replies have been filed by respondents no. 1 and 2 and respondent no. 3 vide emails dated 30.06.2025.

The relevant part of the reply filed by respondent no. 3 reads as under:-

“2. That this Hon'ble Tribunal vide order dated 24.07.2024, Joint Committee constituted by this Hon'ble Tribunal submitted the report stating that "The MC, Palwal, undertook the following measures: Cleaning the site, removing all solid waste, clearing the drain, installing lights, erecting boundary fencing, and placing warning and information boards to prevent future waste dumping. Additionally, an employee has been assigned by MC, Palwal, to monitor the site and enforce fines for violations. The complainant expressed satisfaction with these actions, and a signed inspection report has been obtained to confirm this.

It has also been reported that on 03 February 2025, the concerned field officer of HSPCB conducted a follow-up visit to the site to verify the actions initiated by the Municipal Council of Palwal regarding the regular maintenance of cleanliness and site found clean and in compliance.

3. That said report dated 19.03.2025 has been registered as MA No.44/2025 and notice has been issued for filing reply. Present reply is being filed through District Municipal Commissioner, Palwal who is authorized and competent to file the present reply on behalf of answering respondent.

That after receiving of notice in present matter, direction was given to Junior Engineer, MC Palwal and Sanitary Inspector via letter bearing memo no. 2017-18/MC/PWL/2025 dated 18/06/2025 to visit the site and give reports regarding the same so that report may be filed before this Hon'ble Tribunal. Accordingly, site was again visited by MC officials on 19.06.2025. During visit it was found that there was no such dumping of waste and barbed wire fencing alongwith cautionary Sign Board were found intact.

5. That it is most respectfully submitted that waste referred in the complaint was lifted and sent to 1.5 acre site at Firojpur, Palwal where daily generated waste is being scientifically handled

following windrows method and with the help of trommel machines. The relevant information pertaining to handling of solid waste is as under:

A. Door to Door Collection and Transportation as well as handling of Solid Waste in MC Palwal is being done by the Agency M/s Classic Manpower & Construction Services. Daily generated waste is 106 MT tentatively.

B. Total of 84 vehicle/machinery (37 Tipper, 13 Tractor Trolley, 30 Rickshaw and 3 JCB Loader) is being used by the agency.

C. Daily generated and collected waste is transported to 1.5 Acre land situated at Firojpur, Palwal which is under ownership of MC, Palwal. The MRF is also available at this Site where recyclable etc waste is sorted out.

D. Trommel Machine (capacity 400 TPD) is installed for segregation of waste. Good soil is being given to farmers by the Agency hired. For disposal of RDF, the agency has executed agreement with (1) RAC paper mill, Modi Nagar, (2) Suchi paper mill, G.B. Nagar Uttar Pradesh.

E. Bio-culture is being done on regular basis to stop smell and insects (mosquito and fly).”

We have gone through the report and we are of the considered view that in view of the submissions made no further action is required to be taken on the present miscellaneous application in respect of the grievances raised by the applicant.

M.A. No. 44/2025 is disposed of accordingly with further directions to respondent no. 3-MC, Palwal to ensure due compliance with the provisions of the Solid Waste Management Rules, 2016 and directions given by this Tribunal in O.A. No. 606/2018 titled as Compliance of Municipal Solid Waste Management Rules, 2016 and other environmental issues and O.A. No. 458/2023 titled as Prakash Yadav Vs. State of Haryana and others.
