In this original application, the Tribunal is considering the issue of chromium contamination at Rania, Kanpur Dehat, Rakhi Mandi, Kanpur Nagar and Fatehpur.

Learned Amicus Curiae had visited the site, given certain suggestions and had pointed out as many as 22 recommendations which require immediate consideration and intervention.

Learned AAG in the proceedings dated 30.01.2025 had accepted the recommendations nos. 2,4,6,8,9,13,14,15,16 and 17 and in respect of recommendation no.1 she had submitted that a Committee was constituted to do the feasibility study in 3 districts.

Reply on behalf of Principal Secretary, Environment, Forest and Climate Change, Department of Govt. UP dated 17.03.2025 has been filed responding to the recommendations of the Amicus Curiae. In respect of recommendation no.1 concerning installation of RO – NF Water Plants to ensure clean water supply for all domestic purposes in the affected area in Kanpur Nagar, Kanpur Dehat and Fatehpur, response filed by Principal Secretary, Environment, Forest and Climate Change, UP reveals that adequate arrangement for supply of water for drinking and domestic purposes are not made. On examination of the details disclosed in respect of the railway colony at Afeem Kothi where settlement of 5000 people is disclosed, we find that supply of water from 10-11 tankers is only 50 kld which is far less the requirement considering even the

conservative consumption norms. Same is the position in respect of other areas also. Reply discloses the scheme which will be completed for supply of surface water in those areas but immediate concern is forthcoming summer season when adequate supply of water is essential for survival.

In the feasibility report concerning item no.1 relating to supply of water (page3474) it is mentioned by the committee that 135 litre per head per day water is required by those living in that area. State must ensure adequate supply of water.

Learned AAG has submitted that the issue relating to supply of adequate water in all the affected areas will be re-examined and appropriate provisions will be made and fresh report in this regard will be filed.

In respect of other issues, Learned Amicus Curiae is permitted to examine the reply of Principal Secretary, Environment, Forest and Climate Change, Department of Govt. UP and summaries the lacunas/short-comings/lapses in the said report.

I.A. No. 261/2025-Learned Counsel for the applicant in IA seeks permission to withdraw the IA with liberty to file a fresh properly drafted IA. Prayer is allowed. IA 261/2025 is dismissed as withdrawn with liberty as prayed for.

Officers of UP Jal Nigam, Jal Kal Department and Health Department will virtually remain present on the next date of hearing.
