In compliance with our previous order dated 28.04.2025, learned counsel for Respondent No.1- MCZMA has filed reply affidavit dated 29.04.2025 along-with I.A. No.195 of 2025 (WZ). Prayer is made in this I.A. for exemption from payment of cost of Rs.10,000/- for nonsubmission of their reply affidavit.

It is submitted in the above I.A. that information was awaited from

the Fisheries Department and the District Collector, Raigad till the date when the cost was imposed on Respondent No.1, because of which reply affidavit could not be filed from their side.

In view of above averments, we allow I.A. No.195 of 2025 (WZ) and exempt Respondent No.1 from payment of the cost of Rs.10,000/- and take on record their affidavit.

I.A. No.195 of 2025 (WZ) stands disposed of accordingly.

Learned counsel for Respondent No.1- MCZMA has drawn our attention to para nos.15 & 16 of their reply affidavit dated 29.04.2025, in which we do not find anything specific to have been mentioned as to by when the demarcation of the Fishing Zones, fish landing points and fish breeding areas in the CZMP Map will be prepared for Tq. Uran, DistrictRaigad, though in the light of the averments made in para nos.14 15 & 16, it is submitted by learned counsel for the applicant that the said work will be completed within a period of two months by the National Centre for Sustainable Coastal Management (NCSCM).

Learned counsel for Respondent No.2- NCSCM has also drawn our attention to their affidavit dated 28.01.2025, in which we find that regarding above averment, nothing has been stated. In this regard, learned counsel for Respondent No.2 has submitted that the said exercise will be completed within two months and thereafter, he would be filing latest affidavit within two weeks. We grant him the said time.

We also find that no reply affidavit has been filed by Respondent No.4- Assistant Commissioner of Fisheries, Mumbai, which is also being represented today by learned counsel Mr. Aniruddha Kulkarni, who submits that he would be filing reply affidavit in this matter within two weeks. We grant him the said time by way of last opportunity with a direction that a copy of the same be served upon all other parties, who

may file rejoinder affidavit against the same, if any, within one week thereafter.

Registry is directed to list this matter for further arguments/final hearing on 14.08.2025.

The interim stay, which was granted by us by order dated 04.02.2025 in para no.5, shall still in force till the next date of hearing.
