namely Mr. Bittu Bala Sic) Brajen Bala, aged about 27 years (Helper),, Mr. Nirmal Bala, Sic) Sudhir Bala, aged about 56 years (Manson), Mr. Tushar Bala S/o Ramesh Bala, aged about 49 years (Carpenter) and Mr. Santosh Kumar S/o Rama Shankar Das, aged about 29 years (Tag Welder) could not escape and met with their sudden and unfortunate demises. The hard rock further fell on the Rock Breaker parked nearby however the Operator of the said Rock Breaker escaped without any injury. Rest of the 8 workmen have escaped safely including one workmen namely Dilip Bairagi with minor injuries. That post collapse, the rescue operation was promptly initiated in the presence of officers of the NMDC Limited, M/s Larsen and Toubro Limited and Tata Consulting Engineers with the appropriate and suitable coordination with the local administration and dead bodies of all four deceased workmen were recovered and the answering Respondent and the contractor M/s Larsen 86 Toubro Limited made suitable and proper arrangement to ease and normalize the situation and dead bodies of workmen were sent in separate ambuiances to their home town in Bihar and West Bengal along with the representatives of M/s Larsen 86 Toubro Limited. It is further submitted that injured workmen Dilip Bairagi was undergone a thorough medical heck-up cost of which was borne by the Contractor M/S /Larsen 8s Toubro Limited and having been satisfied of his fit physical condition, he was also paid a compensation of Rs. 15,000/- by the Contractor and additionally full wages for the period of treatment was also paid to him. He is presently physically and medically fit and working at the same site with the Contractor M/S Larsen & Toubro Limited. It is further submitted that after intensive search operation and having been fully ensured and satisfied of the fact that no other workmen was affected from the collapse, the incident area was barricaded and ambulance
