We are passing this order in continuation to the earlier order dated 28.05.2024.

In compliance with our previous order dated 28.05.2024, the respondent No.3- District Collector, Palghar has submitted their report dated 23.07.2024 before this Tribunal, wherein it is recorded that four labours namely 1) Amol Anant Ghatal; 2) Nikhil Arrant Ghatal; 3) Sugar Sunil Tandalekar; and 4) Shubham Suryakant Parkar, died due to inhaling poisonous gases during the process of cleaning sewage treatment plant. This plant is being run by the Pollucon Envioro Engineers Private Limited. Regarding this, an FIR has been lodged against the accused persons, whose names are given in para no.2 of the said affidavit/report.

As regards compensation to legal heirs of the deceased, it is stated that the Hon’ble Supreme Court in Writ Petition No.324/2020 vide order

dated 20.10.2023 has determined the compensation in such cases to be Rs.30 lakhs per head. Accordingly, Pollucon Envioro Engineers Private Limited was directed to pay the said amount, against which the said company filed Writ Petition No.7616/2024 before the Hon’ble High Court of Bombay, before which instruction has been issued to the Pollucon Envioro Engineers Private Limited to deposit Rs.25 lakh in the account of the District Collector, Palghar and the said amount has been deposited but the matter is still under consideration before the Hon’ble High Court.

We find from the above that the cognizance has been taken of this matter suo moto by the Principal Bench of this Tribunal and there is no other issue involved in the present Original Application, except the compensation to be awarded to the legal heirs of the deceased, which appears to be under consideration before the Hon’ble High Court. Therefore, nothing remains to be decided in the present Original Application and dispose of this application accordingly.
