This original application is registered suo moto on the basis of the news item titled "6 Killed 1 injured in Chemical Factory Fire near Jaipur" appearing in News 18 dated 23.03.2024.

New items relates to a fire break out in a chemical factory near Jaipur, Rajasthan that resulted in death of six people and injury to one. As per the news item, fire started late in the evening after the explosion in a boiler of the factory in the District Bassi area. News item does not disclose any steps taken by the authorities for payment of compensation to family members of the deceased persons or to the injured.

The matter was taken up by this Tribunal in light of the order passed by Hon’ble Supreme Court of India in the matter of Municipal Corporation of Greater Mumbai vs. Ankita Sinha & Ors. reported in 2021 SCC online SC 897 and constituted a committee directed the State Pollution Control Board to submit the factual and action taken

The State PCB filed the status report with the facts that all the deceased members have been paid a reasonable compensation to the tune of Rs. 13,00,001/-

Reply has been filed by the respondent no. 3 with the facts that the family members of the deceased persons have been paid compensation to the tune of Rs. 13,00,001/- and further submitted that all necessary assistance to the family members of the decesased employees were provided in addition to amount of ESI, Provident Fund and other contributions. The Rajasthan State Pollution Control Board has submitted that the unit has valid consent to operate till 31.12.2027.

Learned Counsel for the State has submitted that a reasonable amount of compensation has been awarded to the aggrieved and in case anyone aggrieved by the order of payment of compensation they may approach to the competent forum with reasonable justification for enhancement and payment of rest of the compensation if any found by the competent forum.

In view of the report submitted by the State Pollution Control Board and reply submitted by the respondent, we are of the view that the substantial amount of compensation has been awarded to the aggrieved. Since no objection has been filed by anyone, thus, no further action is required.

The Original Application No. 113/2024 stands disposed of in view of the compensation paid.
