Issue raised in this application is sand mining leases in the District Dewas, (M.P.), which were auctioned by MP State Mining Corporation in terms of Madhya Pradesh Sand (Mining) Transportation, Storage, Trading, Rules 2019 in the month of June, 2023. The contention of the applicant is that theses 28 Sand Mining Leases which were auctioned for the District of

Dewas are submerged in water throughout the year therefore making it practically impossible to excavate sand from any of these 28 Mining Leases. The District administration has wrongly identified and allocated theses Sand Mines and the District Survey Report prepared for the District of Dewas also shows incorrect factual position of availability of sand in these 28 Sand Mining leases. State Mining Corporation being the custodian of these leases is creating undue influence on the State Functionaries such as MPSEIAA to grant Environment Clearance to theses leases, wherein legal procurement and extraction of sand is not possible.

In the second matter, Original Application No. 66/2024, the mining and excavation District - Harda was raised and on the similar ground with the allegation that the mining in the area where the DSR has not been prepared or no identification of location has been done mining is practically impossible.

The matter was taken up by this Tribunal and with the concurrence of the learned counsel for the parties both the matters are taken together.

A committee consisting representative of the Collector and State Pollution Control Board was constituted with direction to submit the factual and action taken report. In light of above, the committee visited the site and submitted the report as follows:-

B. FACTUAL OBSERVATIONS OF INSPECTION: -

i. 16 sand mines were inspected between 21/06/2024 and 22/06/2024. Out of 16 sand mines, 8 sand mines were found approximately 100% submerged, two sand mines were found approximately 60% submerged, one sand mine was found approximately 80% submerged, one Send Mine was found to be approximately 90% submerged, one Send Mine was found to be approximately 75% submerged, one Send Mine was found to be approximately 20% submerged, one Send Mine was found to be approximately70% submerged and one Send Mine was found to be approximately 40% submerged.

ii. All 16 sand mines have not been given environmental clearance (EC) by MPSEIAA.

iii. All 16 sand mines have not been given Consent to Operate (CTO) by the State Pollution Control Board.

iv. According to the information of Madhya Pradesh Pollution Control Board, Mandideep, public hearing has been held for Environment Clearence (EC) of 12 mines and the proceedings are under process in SEIAA Bhopal.

2. The EIA study Report shall have to be prepared by the State Mining Corporation in such a way that it should not only contains the Water and Air Quality monitoring data’s of one year of all seasons but should also contains the details of submerging area of all sand mine individually for all seasons of the year i.e. may be excluded for Rainy season.

3. The calculation of submergence part of sand mine area and physically verification/ Inspection shall be done by the State Mining Corporation & Mining Officer, thereafter the TOR shall be issued by SEAC for further process i.e. Public Hearing etc.

4. Record of depth of river shall have to be kept by Mining Department for all sand mines area which is considered for EC and further tendering process.”

The respondent no. 5 Central Pollution Control Board has submitted that the provisions contained in Mining and Mineral (Development & Regulation) Act, 1957 provide the legal action against the illegal mining by the state agencies.

Notices were issued to Madhya Pradesh State Environment Impact Assessment Authority (MPSEIAA) and repeating the same contents it has been submitted that the decision with regard to the EC of environmental clearance is pending due to pendency of this petition and in some other matter EC has been recommended. All five points which has been recommended by the joint committee report the same has been repeated by the MPSEIAA.

Learned counsel for the State Mr. Prashant M. Harne has filed the reply on behalf of the State of Madhya Pradesh and submitted as follows:-

i. “In the district of Dewas, a total of 28 sand mines have been duly approved and sanctioned for operation by the Madhya Pradesh State Mining Corporation. These mines have been functioning and operational in the preceding years, contributing to the ongoing extraction of sand. It is further submitted that Google satellite imagery provides a visual representation of the mining sites during the months of April, May, and June, the water levels in the respective areas experiences a significant decline. This reduction in water levels has facilitated the uninterrupted and continued mining of sand during this period.

ii. The tender for excavation on the 28 sand mines located in District Dewas was awarded to M/s Param Agency, Bhopal, by the Madhya Pradesh State Mining Corporation for a period of three years, from 2020 to 2023. It is further submitted that, M/s Param Agency, has deposited an annual sum of ₹41,65,50,245/(Rupees Forty-One Crore Sixty-Five Lakh Fifty Thousand Two Hundred Forty-Five) for each year of the approved period as royalty. This annual financial contribution constitutes as a significant source of revenue for the state. It is further submitted that the closure of these mines, without due process, would result in irreparable financial loss to the public exchequer. Such a closure would lead to the cessation of substantial revenue generated from the mining activities, which plays an essential role in bolstering the state's economic resources.

iii. All sand mines that have been approved within Dewas district have duly obtained the requisite environmental arances in accordance with applicable laws and regulatory standards. These clearances ensure that the mining operations adhere to the environmental guidelines established to mitigate ecological impact. Furthermore, these sand mines have been in continuous operation for a period spanning the past 15 to 20 years. The prolonged duration of their operation signifies their compliance with both environmental and legal requirements, thereby demonstrating a stable and regulated mining process. The consistent functioning of these mines over this extended period reflects their importance to the local economy, as well as the

regulatory oversight by relevant authorities, ensuring that environmental standards are maintained.

iv. That in the fiscal year 2020-21 up to the present date, the Mineral Department of Dewas has registered a total of 1,038 cases related to illegal mining and transportation activities. In conjunction with these cases, a substantial penalty amounting to ₹5,33,89,240/has been successfully recovered. This enforcement action underscores the department’s commitment to curbing unlawful mining practices and ensuring regulatory compliance. The ongoing enforcement efforts and the substantial financial penalties imposed highlight the department's vigilance in regulating the mining sector, thereby reaffirming the availability of sand in the authorized mines and the effectiveness of the regulatory framework in managing mineral resources.

v. That a District Survey Report dated 27.08.2022 was prepared for District Dewas and that the same is valid for the five years.”

In view of the above contention, both the parties are at agreement that the recommendation of the joint committee report and the recommendation of the SEIAA must be acted upon and mining departments should be directed to act in accordance with the recommendation to follow the guidelines and Sustainable Sand Mining Management Guidelines, 2016 & The Enforcement and Monitoring Guidelines for Sand Mining, 2020. Accordingly, we direct as
