This is an application to extend the time granted for curing the defects.
The facts of the case are that the Appellants e-filed the Memo of Appeal on 17.07.2026. The Office after scrutiny of the Memo of Appeal on 29.07.2026, intimated the defects to the Appellants on the same day. The Appellants re-filed the Appeal on 25.08.2026.
Heard Ld. Counsel for appellant and perused the averments made in the IA as well as Office report.
Considering the reasons mentioned in the IA, which are found to be sufficient, the delay of 20 day in re-filing the Memo of Appeal is hereby condoned.
It is submitted by the Ld. Counsel for appellant that this matter has been mentioned by the appellant before the Hon’ble Bench and the Hon’ble Bench has allowed listing of this Appeal for 09/09/2026.
In view of the submissions made by the Ld. Counsel for appellant, let this case be listed before the Hon’ble Bench under the heading ‘for admission (fresh case)’ on 09/09/2026 .
